Hello,

I am a little confuse about my situation and i was woundering if you can help me or direct me to the right people so i can get the right informations.

I am a canadian citizen who is planning to marry a american citizen, i know that he needs to send the application of the 325 and the K1 with all of his and my info proof of citizenship (passport and all) but my question is that i am withchild and we want to be marry now and be together through out the pregnancy... as soon as we can...

I know that a canadian is allowed to be a long term visitor up to 6 months...

But is there something special i need to do...a special form or another kind of application, for a long term visitor?

And is it a safe and possible according to your laws of immagration?.

Last thing i want is not to be legal or make any mistake, then be deported and never to be able to be together again.

Just my advice, but it sounds like you should come to the states as a Visitor for 6 months and then work on the K-3 or K-1 from here. The K-1 will take you at least 9-10 months to get. This will only allow you to come into the US to get married, and then do Adjustment of Status which will allow you to get a permanent resident card.

It depends on the situation, but there are alot of us that have had problems going back and forth to Canada once the paper work is in.

The K-3 is filed after you are married and I am sure they will require you to leave the country while it is being processed.

you are only allowed to stay 6 months in the US as a visitor (which I did) I then returned to Canada. DH came there we were married Oct 3-03 he went home to the US we filed the I129F and I130 total time I think was 8 months. I arrived in the US June 12 04... there is NO way to speed it up and I am not aware of any forms you can file to stay longer. In fact when I came for 6 months, I got pulled in the office and it was the sole decision of the officer to let me "in", and I think I got lucky. Well I wish you all the best hunnie but prepare to maybe have to do this the long way and "alone" sorry :(

I'm not aware of any special form or application for a long term visitor. I visited the US for almost 6 months (177 days to be exact) after we got married, and then I came back home to Canada. When I was crossing back, the officer (Canadian side) asked me how long I was away. When I told her for how long, she asked me if I had permission to stay that long. I forget the exact words she used. Anyway, I was a bit shocked she asked me that question as I know nothing about applying for a longer stay. So, I just said, "Aren't we allowed to visit the US for 6 months?" She didn't respond and just checked my luggage and then let me go.
