Hello again fello vj members,

After getting enough info , we are planning to cancel the I-130 filed for my 2 kids and have their Birth certificate corrected.

Once it is fixed we will refile them again. Last July of this year i filed for my Removal of condition.

Here are my concerns:

1. Is cancelling the I-130 affects my removal of condition?

2. If we refile again the I -130 after the kid's Birth certificate are corrected..do we have to pay the filing fee again?

3. Once the Birth Certificate s are corrected.. do we have the chance to be approved?

I hope ppl here would not judge me for the mistakes of the past. Thanks and I would appreciate your help.

Talking about hitting the wrong key this early, post above jumped up and wouldn't let me edit it.

Isn't your husband applying for the I-130 for your kids, and you are applying for the I-751 for yourself, two different processes and independent of each other, one should not affect the other. I applying for the I-130 for my wife's daughter didn't make complete sense, seems like both of us should be applying for her, but that is how the USCIS operates.  It's her daughter, I am just the step dad  and as the step dad, if anything went wrong with our marriage, I would no longer be legally responsible for my step daughter, but my responsibility to my step-daughter, say like she got into trouble with the law with some kind of fine, wife would be fined, and as her husband, equally responsible for my wife's debts. So considered adoption, but with Venezuela, would have taken more than five years and cost a small fortune.

I also saw typos in my step daughters' birth certificate made by the Venezuelan government, looking at my keyboard, the letters, "B" and "V" are right next to each other.  Was that way since birth, couldn't be too hard on my wife, she was married to a very abusive husband, getting that corrected back then was the last thing on her mind.  But it had to be corrected, 100 bucks to one of their notaries with a $400.00 US dollar tip so they would do it now, back then, not two years from them. They love US dollars.

Other major headache was getting permission from my wife's ex to bring his daughter over here, even though he had abandoned her for seven years, that is not how the courts of Venezuela looked at it, had to get is permission, that was very expensive, with my thoughts after going through all this, will we be happy together as a family, gets complicated when kids are involved.  But got all that squared away before applying for the I-130 for both my wife and step daughter, that went smooth for us. We had some problems, adapting to each other, my kids were very successful in college and the work place, demanded the same of her. She is a high honor roll student at college today.

Not sure why you want to cancel your I-130 for kids, keep it active, and get it corrected. Who is taking care of your kids Don't you worry about them?

Why would an I-130 for your kids affect YOUR I-751.... They are not linked or dependent on each other in any way...
