My husband and his two teenagers have been here since the end of January. It's too long to explain but essentially my husband's son wants to go back to live with his grandparents in Canada. What is the process for this ? They are here on a CR-I and due to remove conditions January 2011. Do we need to notify someone or is there paperwork for this ?

I am sorry to hear this, but I understand and am in the same situation possibly with my own teenage daughter.

My understanding is that to re-enter Canada there is nothing you need to do - if he's a Cdn citizen, which I assume he is, he is free to return to Canada. He'll have a 3 month waiting period until he is eligible for Provincial healthcare again, you'll probably want to get some kind of interim coverage, since he basically has nothing. I think you may want to report that he is returning to Canada - he may get some type of stamp that starts that 3 month waiting period or something along those lines

Depending on his age, you'll probably have to give some kind of joint guardianship to the grandparents in Canada. I think if you don't remove conditions for him, then his 2 yr GC will naturally expire on it's own, I don't think you need to do anymore on the US immigration side.....but I may be wrong and wouldn't want to steer you in the wrong direction - I haven't figured this one out yet myself.

If (and you know he will) he changes his mind or just plain old wants to come visit, I don't know how much hassle he'll get at the border because obviously his passport has the old documentation stapled in it.
