Extension to stay in the US

Hi people,

I just want to ask if there is anybody here that already applied for an extension to stay in the US for their parents.

My mother has her tourist visa when she entered in the US in Sept. She is allowed to stay till March, basically 6months. However, I want to extend her stay since she is helping me with my first born baby. If I apply, is there a maximum stay of extension, e.g. 6 mos? HOw do I apply?

I need advices.

Your mom would need to file Form I-539 (Application to Extend/Change Non-Immigrant Status). Please note that she should not apply for extension of stay within 3 months of coming to the USA otherwise USCIS will suspect that she is intending to stay permanently. USCIS says to file at least 45 days prior to expiration of I-94.

Do not mention you want the extension to help with the baby. USCIS sometimes considers that working.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
