Good morning everyone

I had my interview on March 26,2009 the interview went good but the CO gave me my passport back and she says she needs to do some AR .

every time i call DOS or send emails to the embassy asked about my status they said ''the case is pending AP''

on July 30,2009 i got an email from the embassy asked me to send them my passport .

they got my passport on Aug 2,2009.

since that day every time i email them to ask my status they say '' the case is pending CO review''

the embassy called me and they told me to go to them on Sept 27,2009 for a second interview .

i had a second interview on Sept 27,2009 it was very long interview about 40 minutes with 2 CO a man and a woman.

after they done i asked them if we are approve or if there any new news for us ? they said no good news no bad news .and they need to talk to my fiancee .

they didn't give me my passport back .

We sent them ''Emails and they said the case is pending CO review''

Last week we sent them Emails and they said '' the case is under ongoing AP !!!!''

My fiancee called them to see whats going on they told her that the case is under ongoing AP .she asked them if they are going to send our case back to USA or if they are going to deny us they said no .they said they just looking over a couple of documents!!!

I was wondering why they put us again under AP if we already have been under AP for more than 5 months ?!!!!

BTW they didn't call her so far and she tried to talk to anyone in charge of our case but the embassy didn't allow her to talk to anyone of them .

My fiancee asked her congressman and her senator for help .and they the embassy sent them Emails and they said '' the case is under ongoing AP....''

I was thinking that they might put us under AP for another 2 or 3 months and then they will send our case back to USA for review .so it will expire and they will close it there in USA.

What do you guys think about that ?

Sometimes no news is good news. It seems like that you're going through the standard AP time. I would think if they were going to deny you they would have done it from the beginning. I haven't heard of cases that went through 6 months + of AP and then getting a denial. There have been many others who have went through longer AP times and finally the visa was issued. I'm sorry this is happening to you. I wish you nothing but the best.

This has happened 3 times at Cairo in the last month or so...AP, then no AP, then its AR then it IS AP. Or "no AP, just final AR" then it turns out to be AP

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Sorry to hear about your long wait. My girlfriend that did a K-1 visa from the vermont center, that was done in May 2009, they have sent there papers back to USCIS, she got a letter from USCIS for an under review and as she has called them they told her to wait up to 120 days for further information. She is wandering also what is going on. She has only been to Egypt once, but they were married here in the states when he was here on a special visa, then she married 3 days after me May of 2008, she is thinking it's because of the time frame from her last visit has been so long. She has called the USCIS and there giving her nothing also. I will keep you posted if I find out any other information. Did your wife go to the interview with you, im wandering if that makes a difference, I know in Flowers case it didn't so maybe there is no method to there madness, I wish you well and your visa soon, this is all such a stressfull process. Have to be strong and keep your faith. Take care.

Cairo is known to jack folks around. Just try your best to hang in there and don't panic. You will get your visa at some point. I know how all those negetive questions keep dancing around in your mind, but you just have to dismiss them. They can't keep your case in AP forever. Ask G-d to give you peace and the grace to get through this rough time.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Like others have said, you should hear something soon. Honestly, for Cairo, you're right on target or perhaps a tad over. Our case took 4 months post interview to get the visa. We've had some Cairo people wait a year or more after the interview to receive the visa. This is after home visits and second interviews. I believe if they were to send the case back to the US they would've done so by now. Maybe I'm wrong but it seems that if they intend to do that they do it fairly quickly.

So to answer your question, no I don't *think* they will send it back.

I'm so very sorry you're going through this but just take it one day at a time. You haven't mentioned a home inspection yet so maybe that is next on their agenda. Cairo was very disorganized when we went through the process and what they would say via email was hardly ever what was really going on. I think they just copied and pasted the same response over and over no matter who they were writing too. Keep the faith and just put one foot in front of the other. We went through three interviews and two home visits totalling 8 mos of AP and we're kind of wimpy so if we can get through it so can you!

Don't worry so much , it is just time if they want to deny your case they could do it since your first interview

my interview was at Kuwait cause i was living there since 2 years

my first interview was on 1 mar 2009 and second interview on 21 mar 2009 , then she told me u are under further administrative process

i still in it for 4 months m then they asked me to bring my passport even i paid at dhl for package delivery

just 2 days they sent email informing me that my case under further ap again

after 45 days i was going to send email telling them they bring my passport back for renewing my residency , but i found a call from dhl tellng me we will bring your passport tomorrow , i aske them is it package or just passport he told me i don't know

i didn't think it is the package because they didn't inform me with any thing , i thought it is just the passport

next day he came and has the package with my passport

and it was written in the visa the day of ap clearance , it was the previous day the issued the visa

inshallah u will get good news soon[/color]

Hot Guy- I know this whole process sucks... and it is made worse because we never get any information. The whole idea of waiting without knowing for how long; or what the outcome will be is driving me crazy. :cry: I think I would be even more frustrated if they kept asking me for things like they have with you.. at least in my case, all has been quiet since the interview in April..

I would like to know this whole thing about 'sending the case back to US'. Would they tell you? Why might this happen? Would you have to start the whole process over again? I know there is some sort of "expiration" thing... which I am praying automatically gets renewed.

Agh- too many questions about everything!

Insha'Allah, things will start coming together soon for all of us that have been waiting.

Ap is the worst part for that journey and i'm really sick of waiting .we contacted everyone to help us but the white house .and still no news .i even asked the embassy very direct question and i told them to give me a direct answer i said '' are you going to give me the visa or you will send my case back to USA so it will expire and they will close it there ?'' they said the case is pending Ap LOOOOOL.

Well about sending the case back to USA yeah they should tell you that they will send it back to USA for futher review but sometimes they don't say anything about it .cause they don't want you to argue about it with them .and you will not know till the USCIS send you a letter saying that they get your case !

Why might that happen ?

Petitions/applications are returned for a variety of case specific reasons. Returning a petition/application to the USCIS means that the embassy/consulate refuses to issue a visa to the beneficiary, but they do not have specific evidence to actually deny a visa application. So the next best thing to do is return the petition/application to the USCIS office where the petition was originally filed requesting further review and ultimately recommending revocation.

Well talking about if you have to start that whole process over again .yeah maybe you will have to do that.cause in most cases after the USCIS get the case they let it till its expire .and once its expire it means you have to start that sh*t all over again .

here is what will happen if the embassy send the petition back to USCIS

  • 221(g) is issued to beneficiary at conclusion of the interview stating the application and/or petition is being returned to the United States.
  • Petition is returned to the United States by the interviewing consulate for "further review" in what is called a diplomatic pouch.
  • Returned petition is received by the NVC. It is reviewed and entered into the fraud database by fraud management.
  • Returned petition is sent to the local USCIS service center where the petition was originally filed and approved.
  • Local service center receives returned petition.
  • Local service center who processed the original petition sends a notice of receipt to the petitioner.
  • Local service center reviews the returned petition and consular officer notes on the case.
  • Local service center then sends either a NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also asking for more proof of the relationship, many cases have specific consular objections to rebut.
  • Petitioner is given 30-60 days from date of NOIR/NOID (depending on the service center) to respond with additional evidence of the relationship or other specific evidence. The timeframe to respond will be provided in the letter.
  • Local service center receives evidence...if in the timeframe given (30-60 days) the case is reviewed and either original approval is reaffirmed or the petition is officially denied.
  • If the petition is denied the local service center sends the petitioner an 'official' denial letter. This can be officially appealed if the denial letter states such.
  • If the petition is reaffirmed the local service center sends the petitioner an official notice of reaffirmation.
  • Local service center sends the reaffirmed petition AND its evidence provided in the rebuttal directly to the consulate along with a recommendation to issue a visa.
  • Consulate notifies the beneficiary of a new interview date.
  • Beneficiary has interview for the reaffirmed petition and the visa is either issued, or the case in placed in Administrative Processing which after cleared a visa is issued, or worst case scenario it is denied via Section 221(g) and returned again to the USCIS with a recommendation for revocation.

OK You got to hold it togeather and calm down.... I'm sure it wont be long till you hear something and I think it will be good news. AP SUCKS and we all know this so good. And it dont make any sence that some people only go through it in a couple weeks and some spend years. God willing it will be soon.
