Marrying in SC???

I got my information from the Clerk of Court (York County) and I could not believe it, so she gave me the Probate Judge and he confirmed that you could not get married in Youk Co. without an SSN or Alien Registration. Of course the Alien registration can only be obtained after we are married. Not sure yet about the SSN.

Oh #######!! You're scaring me! York County officials are FULL of misinformation! :angry: I hope this is the case here! :unsure:

So long as you dont want to get married the day after arrival you really don't have a problem. A k-1 can apply for a SSN as soon as they arrive (usual advice is to wait two weeks for the documents handed in at POE to be back in the system so you appear n the SAVE system at SSN office and you dont have to get verification) We applied for my SSN two weeks after I arrived and it arrived in the post about ten days later.

If not, get married in North Carolina, here the alien just signs a form that states you're not a citizen so don't have a SSN. Take a trip to the coast and have a wedding and honeymoon all in one ;)

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

I got married in Beaufort, SC the day after I arrived from Canada. I think I *might* have had to give my A#, but I got NO HASSLE at all!

August 30, 2005 - AOS, , AP applications mailed to Chicago Lockbox

September 9, 2005 - NOA's for AOS, AP, (dated Sept. 1)

November 28, 2005 - AOS biometrics - refused EAD biometrics at the same time

December 5, 2005 - AP approved

December 7, 2005 - Infopass appointment for interim EAD

December 12, 2005 - Received EAD card

December 13, 2005 - Received AP

June 14, 2005 - Case Status Inquiry/Tracer

June 19, 2005 - Letter sent to congressman

AOS INTERVIEW SCHEDULED FOR AUGUST 8, 2006

AOS approved - August 8th, 2006 - hooray - done with USCIS for now!

GREENCARD RECEIVED - August 18, 2006

Hey there. I'm from SC. We were married in May, only 3 or 4 weeks after my husband (then-fiance) arrived. We had applied for Amed's SSN but had not received it, so we just left the SSN section on the license application blank.

They didn't ask to see any documentation except for proof of ID. We had the license back the following day, were married by a notary, and had it filed and copies made the next day. SUPER easy. I think it may depend on what county you're in and to who you talk to. I'm in Charleston. Where are you?

You can get married where ever you want...

However, some states have a rule that if you get married in the State that you live, you have to get the marriage license in your county of residence...

Has anyone gotten married to their forien fiance' in SC immediately upon arrival in USA? I have been told it is necessary to have a SSN or Ailen Registration card in order to apply for a marriage license. I was told at the SSN ofice that we must be married before she can apply for a SSN.

Seem very stupid to me.

I am not married as of yet, and got my SSN in the mail yesterday.

I know this topic is old but I'm bumping it back to the top coz I need some help.... I called the court houses in York and Lancaster county and both of them told me that anywhere in SC is going to require a SSN because that's the state law soooooo.... I called the SSA who told me that he can't get a SSN unless he has work authorization!!! :huh: What's up with that? Anyone had a problem getting a SSN before adjusting status and getting your greencard???? She said this is a new law???? :(

I guess I can cross the border and get our marriage license in NC but he'll have to have a SSN to get a drivers license too right? That means if he doens't come in through JFK or get that temporary work auth from JFK that he won't be able to get a SSN or a driver's license or anything until he gets his greencard??? Which usually takes how long after sending in the AOS application??? :unsure:

:: For K1 Visa Holders ::

As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do

not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA

offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior

to the expiration on your I-94). On the other hand, you should also not file for a SSN too soon either.

You should wait 2 weeks after you arrived in the US before applying for a SSN. If you go too soon your

record of arrival will not be in the SAVE-ASVI system yet, and it will require manual verification from the

USCIS. As this will add weeks to the period it takes to process the SSN, it is advisable to attempt to wait the two weeks to be safe. If you have waited the 2 weeks and they tell you they can not verify you arrival record via the SAVE database, you may allow them to to process it (but remember the potential delay for manual verifications). You can ask if they will check the computer again for you in a few days or return personally to have them look again -- thus eliminating the manual verification. The manual verification will require the SSA office to file a G-845 with the USCIS.

To apply for a SSN you will need to go to your local SSA office and bring the documents below. These

documents are proof of your eligibility to file for a SSN:

1. The SS-5 form you downloaded and filled out (they have some at the office if you forget).

2. your Passport (with the K-1 Visa in it)

3. your valid I-94

4. another form of valid ID (as defined in the SS-5 instructions)

5. You should also bring the document RM 00203.500 that you printed out

Make sure to bring all the documents above because some offices have staff that are not aware

that a K-1 Visa Holder is eligible to file for a SSN. A friendly reminder is a nice thing to have -- if not

you could be turned away incorrectly.

Once you have successfully applied for your SSN, the SSN card will come in the mail in about 2 weeks. You can check on the status of the SSN application and/or often get the SSN in advance by returning in person (try calling) to the SSA office. If you need your SSN before it arrives in the mail you may ask them for an SSA-7028, Notice to Third Party of Social Security Number Assignments, to be sent to your employer or other interested third party once a SSN has been assigned. Your card, when you receive it, will be marked with the words "VALID FOR WORK ONLY WITH INS AUTHORIZATION" indicating to an employer that you must also have an unexpired EAD to be eligible to work.

Yah I know which is where my confusion is coming in..... I just talked to a lady at SSA who told me that it's a new law that he can't get a SSN unless he has work auth. She said IF he gets that temp work auth with his I-94 then he can use that (14-21 days after arriving--which is stupid because that eats up 2-3 weeks of the 12 weeks you're allowed to work) BUT if his I-94 doesn't have that temp work auth (which I been told he can only get at JFK AND he has to ask for specifically or he doesn't get it) then he can't use it to get a SSN????

That's how she's explaining it to me... and again she says this is a NEW law????

Do SSA have different laws in each state or is it across the board the same for all states?? :huh:

Has anyone else heard about this 'new law' that says he's gotta have work auth to get the SSN???

dunno about SC, but in MI no SSN needed. Pras still does not have SSN (I will be going to Soc Sec office next week since I'm "accumulating" for taking off next Friday--for both her med appt. and SSN).

Doubt that SC would be so markedly different--as this could drive couples (and their marriage licence-fee revenue) to other states.
