Nope, makes no difference at all. The only thing they really care about expediting wise (which I assume is why you are asking) is if the USC is military and going to be deployed.

He's not military or anything.

Hopefully the visa will be approved before the baby comes. Really worried about that.

I think the biggest basis on that is how long your consulate takes from the time you get P3 till your interview. By the time I have my interview it will be almost 10 months since I started my journey, but my consulate was booking 4-5 months behind. Only took 3 months to get my NOA2. If you get yours within 3-5 months as well and your consulate is fairly fast then you might be ok. If the consulate takes longer you might not make it. That in mind if you are not the USC you may want to start looking into the consular filing of birth abroad for your baby, incase you don't get it intime, as you will need to register the birth so that your baby will get a passport. It will get citizenship automatically from the USC, it just needs to be registered. Congratulations :D

hmm...editing cuz I think I read this a little wrong, if hes the non-USC they wouldn't care if hes military or not, only if you were. Its the only thing they expedite for though. I will see if I can find how long the Scottish consulate is taking right now.

Do a search on this forum for pregnant K1 filers...some people have had success in writing to their Congress person asking to expedite. It's unpopular to talk about here on the forums, but I think it's a valid reason (whether or not the pregnancy was intentional, both parents bonding at the infant age is very important; I'm a neonatal ICU nurse)

Best of luck to you and your significant other and congrats!

Timeline

Ok it looks like Scotlands embassy doesn't process visa's so they get sent to London, and London's timeframe is approximately 65 days from the time they get the petition from NVC, not too bad, only 2 months. I guess it depends how far along you are and if you get stuck at any spot. Theres always a risk of AP at the NVC stage (which can add up to 5oish days), and it can take up to 5 months sometimes for the NOA2...and if theres any backlog at the consulate, he might not make it in time for the birth. If everything went smoothly *crosses fingers* it could be about 3 months to N0A2, 2 weeks to get from NOA2 to NVC and then to London, plus 65 days, so that would be about....6 months at that point, but thats only if everything goes as fast as it possibly can.

Doesn't even matter...UNLESS the baby is born before the interview in which case your family size for the I-134 increases by one AND you will need to file a CRBA and wait for the baby to get a US passport. The baby will have a claim to US citizenship and is not eligible for a visa (the baby doesn't need a visa, it will be a US citizen)

OK, I misread. The USC is pregnant. OK, makes no difference then. They will not expedite because of pregnancy. But if the baby is born before the interview your family size and income requirements for the I-134 increase

thanks for the replies :)

baby shouldn't be born before the interview...i hope lol. due date is late june im pretty sure, havent seen a OB yet to get a exact date.

hoping ALLLLLL goes well with this. the only problem i'm facing at the moment is trying to find a job. :( i have a home paid for and 2008 tax returns showing where i had made like $26,000 from stocks and stuff and I had a trust fund I had been living off of for awhile, but as of this month, i wont have any stocks anymore and no more trust fund.

i'll probably start a topic when it gets closer to that time :P
