HELLO FRIENDS

I HAVE A SIMPLE QUESTION ...I ENTERED USA ON A K1 AND NOW WE ARE GETTING MARRIED IN NOVEMBER...I HAVE NOT YET FILED FOR ADJUSTMENT OF STATUS I485...BUT ONE THING CROSSED MY MIND IS THAT ABOUT FILING FOR I-131(TRAVEL) AND I-765(EMPLOYMENT).

DO I HAVE TO FILE THESE AS WELL ALONG WITH MY PAPERWORK FOR ADJUSTMENT ? OR IS THIS AUTOMATICALLY TAKEN CARE OF WITH THE I485 PETITION THAT I AM FILING ?CAN I ACCEPT EMPLOYMENT IF MY APPLICATION IS IN PROCESS ???

ANY HELP WOULD BE APPRECIATED

NVC Received : 2008-05-29

Consulate Received : 2008-06

Packet 3 Received : 2008-06

Packet 3 Sent : 2008-07

Packet 4 Received : 2008-07-16

Interview Date : 2008-08-25

August 25, 2008- Placed on A.P.

December 17, 2008- Petition Returned to USCIS for further review.

February 4, 2009- Received notice the USCIS has received returned petition.

June 4, 2009- Petition Reaffirmed by USCIS.

July 10, 2009- NVC sent Reaffirmed petition back to U.S.Embassy, New Delhi.

August 10, 2009- Embassy notified via email that they've received the Re-affirmed petition assigned with a 'new' case number as well as mailed Packet 3.

August 20, 2009- Embassy sent as an email attachment, the DS-230, Applicants Statement and Cover letter to Packet 3.

August 20, 2009- Mailed and Emailed request letter to Embassy to extend validity date of petition.

August 25, 2009 - Embassy received request to extend validity letter.

Sept 2, 2009- Embassy confirmed their receipt of the completed DS-230 and Applicants Statement.

October 29, 2009- 2nd Interview date- Visa Approved!

November 4th, 2009- Received Passport with Visa intact!

December 4th, 2009- Fiance arrived in U.S. - MARRIED Dec. 7th!

February 23rd-Mailed AOS Packet

March 3rd, 2010-Check Cashed

March 6th, 2010-Received AOS Receipt Notice

March 29th, 2010-Biometrics

Sept. 14, 2010-GC Interview -Approved!

You need to apply for these with the application, they are not automatic. You can seek employment while you wait, but not accept a job until you have the EAD.

You file all together at the same time in the same envelope. Nothing is automoatic, never even think anything is automatic. If you file them together with the I-485, there is no fee for them.

Welcome to VJ and congratulations on your upcoming wedding. You need to be married to apply for AOS (I-485) so that is one of the first things you will do after getting married. You prepare separate applications for the Adjustment of Status (AOS), Employment Authorization (I-765) and the Travel Document 'Advance Parole" (I-131) but you mail them all together. Treat each application individually and add the necessary attachments to each form. Then, put all 3 applications in the same envelope and mail them together. They are all covered under the one fee. The EAD and the AP are processed separately from the AOS (and usually faster) but they are based on the AOS so the AOS needs to be filed before the EAD and the AP can be approved.

Read over the instructions and the forms now and you can start gathering together the evidence you need (ie. bank statements, etc. for the Affidavit of Support (I-864), tax statements - you can order in transcripts from the IRS at no charge -, etc.) so you can file as soon as you get your marriage certificate back from the State.

Unless you have an over riding need or desire to travel out of the US before AOS, I would suggest that you do not waste additional funds on a I-131 application; the speed that USCIS is processing AOS applications at the moment is amazing so if you can wait three months then do so and save some green!

Just my two euro's worth :thumbs:

Additional funds?

There is no charge for the Advanced Parole or the EAD if you file with your AOS package. If your GC is delayed, and you need to file they will charge you for those filed separately.

Furthermore, I would for sure not count on getting through the process in three months. I know quite a number of people who are waiting much longer than that.

Nothing amazing for many about the speed USCIS , if this was your experience good on you, but I would not think it wise to state that is the way it will go for all.

They are free when filed with the AOS and they are simple documents, why not? My wife ended up getting her green card before the AP or EAD but nothing lost in the process.

Ooops, my mistake, sorry!

We didn't bother with the I-131 and I thought it was cost but on reflection it was because there was no need for me to travel while the AOS was going on. I was lead to believe that filing through approval was reasonably quick; and indeed it was at 109 days total!

Of course everyone's mileage may vary so apologies for my somewhat misleading posting :blush:

Actually, the I-131 and I-765 fee were included with the I-485 fee in the fee increase of 2007. So you pay the AP and EAD fees whether you apply for them or not.
