Hi guys,

I was refused today as I need to prove my wife meets the US domicle requirement. We live between France and the UK together so she doesn't have domicle in the US. How do I sort this problem out? She already has bank accounts, CA license etc, but hasn't lived in the US for the past year. Also I was refused entry in 05/08 and apparently banned for 5yrs, but the guy told me by filling in the I-212 waiver this would be overturned, is this the case?

Sorry about the denial but domicile, from what I understand, can be proved by tax returns, permanent address, US passport, bank account, voter registration, job/school, etc.

And I don't know about the waiver. Maybe someone else will be more helpful.

Your wife will need to show that she has a residence in the US - when you both move back, where do you intend to live? With parents? Friends? Perhaps a lease, job, school will help with the domicile requirements

As for the ban, are you sure it's a ban? What's the ban for? If you are actually banned, you'll need a I-601 for the ban and an I-212 for the removal if it was an expedited removal. More infomation on this would be helpful

London seems to have tightened up the domicile requirement just recently. Used to be the intention to move back to the US by the USC was good enough but you are the 2nd person I've heard of refused for this reason. A bank account etc doesn't necessarily prove domicile what/whose address is on her CA driving license?

What else did the CO tell you? Offer any suggestions?

The most obvious and simplest solution is for your wife to travel to the US ahead of you.

Ya, proof of domicile has been an issue for GUZ/China DCF'd cases as well.

Petitioner got a blue slip, then went to USA, got a usa job and domicile, submitted the evidence back to the consulate, and then the blue slip was overcome , visa granted to beneficiary.

Suggest the USC make a trip to the USA, get a job and rent a house. Make sure both of your names are on the lease.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

This has become an issue at the Montreal consulate recently as well. Not sure why they have decided to take such a hard line.

Also at this thread, from a person who was recently asked to submit more documentation to Montreal, however, in her case, because they are in Canada, it's easier for him to pop over to the U.S. and gather more proof, not sure how helpful that is to you:
