Probably a stupid question...

Actually it's two stupid questions....but anyway...

Ok, so I filed the I-130 packet and got the I-797C, Notice of Action in return. Yay me!

So in the "Step-by-Step Guide on How to File for a K-3 Visa..." it states that once you receive the NOA1 for the I-130 (which I am assuming is what I have) that I am to assemble the I-129F package and it gives a nice little checklist.

Perhaps this question has been asked before and I haven't looked hard enough but checklist bullet #3 says "Copy of I-130 Transfer Notice (indicating where your underlying I-130 petition was routed to after it was filed at the appropriate Chicago Lockbox)." and then checklist bullet #10 says "Copy of the NOA1 from the I-130".

Please correct me if I'm wrong, but aren't these two checklist bullets the same thing or am I missing something? The way it sounds is that I have checklist #10, the copy of the NOA1 from the I-130 but a copy of I-130 Transfer Notice I'm not so sure about. I told you it was a stupid question ;)

The last stupid question is how do I know where the underlying I-130 petition was routed to after it was filed at the appropriate Chicago Lockbox? Is that the return address from where my I-797 was sent from?

Thanks in advance.

Scott28 - I'm going to assume that your spouse's interview will be in Vancouver and that is why you are going for the K-3. If this is the case, excellent move. This is one of the cases where the K-3 benefits the couple.

Now - when you file the I-129F you include the NOA-1 of the I130.

You can use your NOA-1 to log into the USCIS website to track your petition. If your NOA starts with EAC then your petition is in Vermont, if it starts with WAC then it's in California.

Good luck.

You have assumed correctly, I live in Ferndale, Washington (NW corner of WA) and my wife lives in Surrey, British Columbia (SW corner of BC), and so yes, she will do her interview at the consulate in Vancouver, BC which is only a 25 minute drive from where she works in Burnaby, BC.

So the part about the checklist appearing to say that I need to send a copy of the NOA1 and a transfer notice is probably me just being paranoid.

And the second question about where to send the darn thing is my belief that they should make these things a little more idiot proof...aka the address is on the bottom of the NOA1 but it doesn't specifically say "This is where your I-130 is pending"

Thanks.

Are you asking where to send your I129f petition? You have 4 service centres:

TX

VM

CL

NE

Where did you send your I130 petition? That is where you send your I129f petition.

Best of Luck. Best wishes. Thank you.
