Hello all,

My I-129F for my beautiful fiancee Olga is currently pending at the VCS. I-129Fs are being processed quickly there so I am thinking ahead about my I-134.

I am currently a student and thus currently have no earned income. My income derives completely from an IRA which I inherited when my mother died. I will graduate from pharmacy school in May 2010 at which time I will make significantly more than the minimum required. So my questions:

1) I should submit my 2008 tax forms and my investment statement for my IRA? Anything else? Maybe a letter stating my educational status and median income for a pharmacist upon graduation?

2) Will investment statements for my IRA be sufficient or should I get my brokerage company to write some sort of letter?

I have been very appreciative for this very helpful website and will be appreciative for any further assistance on this particular question.

Thank you, Ryan R. Winter

I don't know about the IRA part, but theoretical employment has no merit with the I-134, either you have the money now, or you don't basically. I could be a doctor in a few years, but that doesn't mean that I absolutely will or that I will find a job when I complete the program.

You will need a co-sponsor.

Thanks, that answers my question about a letter concerning future employment. Also, I should clarify my original post. I don't have any earned income. I do have income though (as reflected by how much I owed on my 2008 taxes!) derived from the inherited IRA. This amounts is above the minimum requirement. So basically my question at this point is whether or not I will need a letter from my investment company or if my monthly statements alone will be enough. I ask because the I-134 asks for bank saving deposits on one line and stocks and bonds on another. My IRA is in a number of different mutual funds.

Thanks, Ryan

1. Yes, include 2008 tax return.

2. IRA statements are sufficient. IRA income IS income. It counts. However, is it enough? You need $18,212 per year for a family of two. If you do not make that and do not have 3 times that amount in assets, you will need a co-sponsor

You do not need a letter about education status or predicitions of future income, they are not considered. You need to show CURRENT income of adequate amount or have a co-sponsor.

I suggest you get a TRANSCRPIT of your 2008 taxes and some sort of statement showing a current income from this IRA. As long as it can be verified and it is above the guidelines, you are good to go. I would also attach a statement of the value of the account as I presume the IRA balance far exceeds the minimum needed for asset qualification if it produces more than $18,000 per year in dividends, interst...whatever. Sounds like you are fine.

Excellent, thanks for all your help. I am now confident that everything will be fine. ~ Ryan
