I read the thread from your link and and while I am personally repulsed by the whole affair, nevertheless I am greatly concerned that the focus is on the minutia of the case and not the overall principle of the matter. I compare this to something like Tabaa v. Chertoff which the New York branch of the ACLU (NYCLU) prosecuted unsuccessfully and lost on appeal to the United States Court of Appeals 2nd Circuit. Scary stuff and after what poor Nagi went through, I wonder if the madness will ever end. Chocolate Jesus doesn't seem to be in any hurry to end it.
