Traveling with a K-3 visa

I need some help! My husband has to travel back to Morocco to be with his mother she is very ill, He will be gone for 2-3 months. Will this affect our A.O.S we had plans to file for that in Feb.2010 we have already filed for a E.A.D and recieved a reciept number. Can he leave for Morocco even though we filed for E.A.D? Does he need to be here? Are there any appointments he needs to be here for? Or does the E.A.D just get approved or are there other steps?

Can he travel on a K-3 visa?

Will this affect our A.O.S?

Will he have any problems coming back to the U.S being gone for 2-3 months?

How long does it usually take for E.A.D? Vermont Service Center

We just had our first son and I want to make sure there is no problems with him coming back home to us! :)

did he receive advance parole?? he cant travel with out it or needs to aquire a travel document.

dont you receive EAD, AP, conditional green card with K3... why do u have to file AOS again.... I am sooooooo cofused... I thought you only do AOS with K1...

To OP. he will have to do biometrics for the EAD.

Nope, conditional GC is received on the CR1. AOS is necessary for the K visa type.

Your husband needs to obtain AP to travel. I believe the K3 is a multiple entry visa, which means he doesn't need AP if you haven't filed for AOS yet.

Please someone correct me if I'm wrong.

Ok so he does need a AP to travel? Ok so since it is a multiple enrty visa can he go and come back with no problems?

My understanding is that if you have submitted for AOS he needs AP. If you haven't, the K3 is a multiple entry visa, he should be able to travel to Morocco and re-enter with no problems.

I may be wrong but I think he doesn't need AP even after you have filed for AOS since he is on K3. I was on the phone with USCIS recently and the agent told me as long as the K3 is valid my wife can travel on it - even though we have filed for AOS. But then he sounded like an 18yr old student so who knows if it was just his opinion. I would suggest an Infopass to get more information. When you find out can you post here and let us all know? You're absolutely wrong. K3 is a multiple entry visa good for two years. The OP's spouse needs to wait until he does biometrics for the EAD before leaving the US or the fee will be out the window and he'll need to start over. Usually they schedule biometrics within a month of receiving the EAD application though.

Facts are cheap...knowing how to use them is precious...
