Hi everyone !

I have some question about the form 1-134 Affidavit of Support for my fiances interview at the London Embassy. I am the petitioner and I was wondering if you can help me clear up a few things?

1) I do not have a job or income at moment. Do I need to fill out an affidavit, even if I don't have income? Do I just fill in assets? I have some money in savings, but do I have to state where it came from? Is it okay if it came from my fiance? I also will have 2 co-sponsors.

2) Do they do background checks on the co-sponsors at the U.S consulate in London?

3) My mom is one of our co-sponsors. We will be residing with her at my parents house. How does she count the household size for the poverty level amount? Would my mom include herself, her husband (he is unemployed), my fiance, AND me if I don't have an income at the moment? Or would I not be included if my mom doesn't claim me as a dependent on her taxes?

4) My mom makes 19,000 USD a year and my parents own their own home. If her assests make up for the income required, then should I forget about having a second sponsor? Or should I play it safe with 2?

5) Does the U.S consulate prefer it to be all income and not assets?

1. You will fill in the I-134 no matter what. You are the petitioner and therefore automatically the sponsor. You can fill in assets if you want, but either way it prob. won't make much of a difference.

2. I don't think that they do background checks at the consulate stage on co-sponsors.

3. You can only have one co-sponsor in the sense that everything does not add up. So one person has to make enough money to be the sponsor on her own. She would have herself, her husband and your fiance in her household I believe because you are filling out your own I-134 so you would be counted on your own.

4. I would say she would be definitely cutting it close for income. She would need $22, 887 in income to be able 125% for the 3 person household. For assets you need 5 times the difference in income. So in this situation she would need almost $20,000 in assets.

5. The consulates typically focus on income mostly. Obv. once assets are depleted they are gone. If I were you I would try to find a different co-sponsor who at least has a smaller family size.

1, Yes

2. I sincerely don;t it but I cannot say for sure what a consulate may do.

3. There can really only be one co-sponsor. You cannot combine incomes. You can submit as many co-sponsors as you want, one on each I-134 but ONE of them has to make enough all on their own, that is the one they will use. So using multiple co-sponsors is simply a waste of paper.

4. You should forget about having a second co-sponsor, yes. Your mom needs to make enough (or have enough assets) to support herself, your fiance and anyone else dependat on your mom.

5. They do not care, "all income" is easier to prove, usually

one small correction. If the mother's husband is a US citizen, adult and has his own income, he is not a depedant and it doesn't matter the amount of his income. Unless he is a foreighn citizen for whom she signed an I-864 he is an adult and presumed to be able to care for himself. Husbands are not claimed as "dependants" on income taxes either

My mom's husband (my dad) lives in the same house hold but does not have a income at the moment, he is unemployed. Would he be considered a dependent? Would he be counted as part of the household size?

Sorry, didn't want to assume anything, but yes "dad" is less awkward than "mom's husband" :)

No, US citizen spouses are not dependants. Her income tax return, even joint, will reflect this. On the I-134, if she is the co-sponsor, only HER income will be counted, even if it is a joint return. She should attach her w-2s to the tax return. On the I-134 itrself, claim only her income. Her family size is 2 (herself and fiance) if there are no other children.
