My fiancee in China has a child but the father took the baby from her last year and lives in another city now. The notary my fiancee is working with in Guangzhou told her she needs to get a paternity test for her, the father and baby to prove the baby is related to her. The hospital documents are not enough according to the notary office. The problem is the father will not cooperate in getting this paternity test even if she could locate him. We listed her daughter on the original visa application. Will the Guangzhou Consulate deny my fiancee the visa without this evidence? Any advice on how to proceed is appreciated. Thank you.

Have you seen a translated divorce document?

Should be a paragraph in there about 'who is to foster the child' and at what percentage.

I don't understand why DNA evidence is required, at this stage, for anything - there's a birth certificate, a hukuo book, and a divorce document.

If she is trying to prove that the child is hers, for some other reason, then I have to ask - whats going on ?

If she intends to immigrate with the baby - a DNA test MIGHT be required, but the VO will issue a blue slip on interview day , requesting a dna evidence kit, giving the address of a usa firm.

No, the US Consulate will NOT deny your fiance her visa without any dna evidence of the child.

However, if the CHILD is part of the package - ie - is getting a derivative K2 visa - then it will be a problem either on interview day, or in any subsequent K-2 'follow to join' paperwork.

IMO - the worse case scenario might be -

yer lass gets her citizenship within 4 years of marrying you in usa, then she files an I-130 for her daughter. as a USC - the daughter would be approved within 9 months.

re: where is the daughter? I'll guess she's parked with the ex-husband's parents.

Jeff - yes... The child will need a notarial translation birth certificate, along with the original.
