my mom is petitioning vietnam consulate to bring over her brother and his wife and two kids. My mom filed the petition in 1998 and now they are real close to an interview date the only thing is the daughter has turned 22 and is not married. My question is will the daughter be able to get a visa because they are giving her a chance to go to the interview even tho she is over age.

The 22 years old getting a visa will depend on whether or not CSPA applies. How long did it take for INS/USCIS to approve the petition and forward it to the NVC. Lot at your Mom's paperwork. There should be two notices from the INS/USCIS; 1st one is for receipt of the petition and the 2nd one for approval. If it took longer than 2 years, the 22 years old will probably get a visa. If it took less time to get it approved, then it is unlikely that she will get a visa.
