Hello VJers,

I have seen much information regarding whether or not to use the IR1 visa over the K3 spousal visa, and if it was up to me I would forget the K3. I haven't seen anyone really comment about what to do if also bringing over a stepchild or child along with the spouse. I have a 4 year old boy (stepchild) with my Filipino wife and we most recently had a baby boy together this month. I was waiting for the baby to come out as well as to figure out more about my currently overseas assignment before I started this visa chaos. Well now the time has come and I'm ready to send out the I-130 and G-325a's now.

From what I have read, applying for your children (including stepchildren) with your spouse through the K3/K4 process is the only way to go besides doing a completely seperate case for each child. Which even then could proove to be difficult for my stepchild based on my wife going through the visa process at the same time. Right?

Can anyone confirm to me that for bringing over my wife, stepson and baby that K3 is the best way to go so they will get a K4 at the same time? Would really suck messing up this paperwork and they seperated things out.

No, it's not the best way to go. Assuming you are a US Citizen, the baby needs a US passport by filing a Consular Report of Birth Abroad and the wife and step-child are best served with the IR1 and IR2 or CR1 and CR2 (depends on how long you've been married). You do file separate petitions but you send them together and they nearly always get processed together.

I am a US citizen. I assumed the baby would have to go through this visa process to get a US passport. Will do some more researching. We have only been married for about 4 months, so I'm not sure either why that matters for CR1 vs. IR1? In particular, what are the advantages to going this route rather than K3/K4?

The above are THE most frequently asked questions in the K3 forum, so do some reading here and study the guide for CR1. IR1 is the visa granted when you've already been married two years. Your assumption about the baby going through the visa process is incorrect.
