Hey gang, hope you are all staying encouraged today...the journey has an end!

I wanted to know what happens if the I-130 gets approved before the I-129F ?

Can someone give me a step by step process of how this will proceded.

Anyone who has had this happen and actaully completed the I-130 ahead of the I-129F

Filed New I-129F form with IMBRA June 19, 2006

NOA 1 June 26, 2006

Touched July 3, 2006

I-129F Approved by E mail August 21, 2006, Just 63 Days

NOA 2 for I-129F Received in the Mail August 26th, 2006

I-129F at NVC

Case Number assigned at NVC August 29, 2006 MNL2006XXXXXXXXX

NVC sends the I-129F to the Manila Embassy August 29th, 2006

Embassy in Manila Receives I-129F August 31st, 2006

Packet 4 Received by Melinda from Manila Embassy October 1, 2006

Interview at Us Embassy Manila, October 18, 2006

Visa Approved! Interview Completed.

Visa Delivered by DELBROS October 28th, 2006

October 30, 2006 Arrived back in LAX with Melinda, were going to Disneyland!!!

November 6th, 2006, Melinda and I are back home in Winslow Arizona loving Life!

Timeline

Looking at your timeline I cannot imagine how your I-130 would be processed ahead of your I-129F. Even if the service centers approve both at the same time, your I-130 is going to sit at NVC a lot longer than your I-129F will. I have been caught up in IMBRA and think my I-130 will be completed before my I-129F and we will be so happy if that happens because my wife will arrive in the US with everything completed and behind her and there will be no AOS at our local office.

04/02/07 Back to Taiwan for visit and Interview

04/06/07 Received CR-1 visa

04/10/07 POE through Detroit

04/30/07 2 Year Green Card Received

01/10/09 File I-751 at VSC

06/24/09 Received 10 year GC

Citizenship

07/27/10 Filing Date for N-400

08/03/10 Check cashed - as of 8/26 never received NOA so made InfoPass

Well, if the I-130 and I-129F get approved within 1-2 week apart, then it is worth pursuing I-129F. But if the I-130 is approved a month before I-129F, then I-129 won't be that useful. I-130 stays at the NVC for about 2-3 months, whereas the I-129F stays at the NVC only for about 1-2 weeks. Of course, the goal of I-129F is to bring the spouse sooner in USA, but the spouse has to go through the adjustment of status after arriving in the USA. The advantage of I-130 is, the spouse does not have to do any adjustment of status as soon as he/she comes to USA.

For now, you can just continue the both routes and see what happens in future. In the meantime, please be familirize with the CR-1/IR-1 (I-130) and K-3 (I-129F) processes. Good luck!

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
