Good afternoon to everyone!! look my case its kind of long :blush: I was raised in the states as a minor and overstayed as a minor when I was 18 my mom petiton for me but my petition got denied because immigration officials believed that my mom commited fraud so I was send to an immigration facility for deportation, after that I was sent home.... So I was never ilegal right?? time as a minor doesnt count as well as when your under paper work or in immigration hands.. right?? correct me if Im wrong :blush:

BUT!!! I had a girlfriend!! (now my wife) she is an american citizen... We married 7 month after I left the states in Panama (im an spanish citizen) (we wanted to know if we could really be married and it worked just fine) she petition for me (cr1) and Im couple of weeks from my interview in the American Embassy in Panama... So I been hearing that cr1 gets denied when you overstayed and Im kind of nervous!! can that happend in my case??? wil they ask me for a waiver even though I overstayed as a minor???....

Another things is I hear that when you are married under 2 years you get a cr1 but if you are over you become a ir1 my interview its couple of days before our 2 years but if I wait to travel after the two years will I become a ir1 (I have things to do down here before I leave and its going to take me a month or 2 to get it done)....

I hear that cr1 get 2 year gc and ir1 get 10 years.. My wife and I are willing to wait a little longer as long as we dont have to deal with immigration for a loooooong time!!! (its being a nightmare!!)

plus she has visited me 5 times between 2006 and 2009 she hasnt being able to visit me for the last 10 month :crying: fisrt of all because we dont have any money and because of her school will they give us problems for that??.... she's being in panama with me 5 times ones in holland and ones in Spain but the dummies in Spain didnt let her in because they thought she was going to stay!!! :angry: she was sent back to Miami!! and she's not going to be able to travel down here for my interview for the same reason we are very very short on money and Im trying to survive on what I got as well as she is..... :wacko:

Look all I want its to go home see my wife we are very young to be exact 21 (me) 22 (her) (finally!!! growing desparate without her) and have a normal life.. Please give me any advise you can for my interview and if anyone can awnser my question I will always thank him/her.....

You'll certainly need an I-212 for the deportation. Illegal presence begins once the immigrant turns 18. How long after your 18th birthday did your mother petition for you? How long after your 18th birthday did you get deported (like actually leave?)

When you first entered the US, how did you enter?

You'll certainly need an I-212 for the deportation. Illegal presence begins once the immigrant turns 18. How long after your 18th birthday did your mother petition for you? How long after your 18th birthday did you get deported (like actually leave?)

Thank you for your quick awnser!! Im sorry I kind of got mixed up she petition for me 1 month and half before my 18 birthday... Immigration sent me to one of their facilities on dec 27 2006 and I left sometime in mid april 2007.... But before I got sent to that place I had a work permit and a S.S card...

So was I ilegal in any moment??

Hi again well they didnt write anything in my passport or gave me any kind of paper... Why?

Thank you very much for everything!! well look I just found the paper that I had to put my finger print... (they kept one as well) it msrked with an X on: For a period of 10 years from date of departure from the United States because you have been found:

X deportable under section 237 of the act and ordered removed from the United States by immigration judge in proceedings under section 240 of the act.

but if I came out on voluntary departure it makes no sense does it?

You didn't voluntarily depart if a judge ordered you deported. You may have physically left the country without a government escort, but you were deported

It sounds like, from the vague description of the paper, that you have a 10 year ban, based on the 'for a period of 10 years' statement. What does that whole sentence say before the box is X?

Well, I'm not a lawyer but if the paper you got that has your fingerprints on it say you have a 10 year ban than you have a 10 year ban - regardless of what you think.

It's lawyer time to figure out this mess. You're in for a long, complicated road

Well, I'm not a lawyer but if the paper you got that has your fingerprints on it say you have a 10 year ban than you have a 10 year ban - regardless of what you think.

It's lawyer time to figure out this mess. You're in for a long, complicated road

Did the issue of the removal come up at the interview?

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
