My husband and I (the one filing for AoS) have been using a lawyer to assist with my immigration. We use one because I am having a rough pregnancy and he is away with the military alot, and we don't want to mess stuff up.

Question I have is this... I sent the paralegal who's assigned to us my husbands income tax forms for 06. 07, 08 , the w-2's for those years and his last pay stub from last year. My husband is National Gaurd, but has been deployed for those 3 years so his income tax form shows basically 5-$10, 000 for each of those years, as he was tax exempt due to serving in a combat zone, and I asked our paralegal to enclose all this as well note that he is military to explain he was overseas and therefore to refer to his w-2's and paystub.

WEll, I just looked through a copy of the packet that the paralegal sent in, and there is no explaination, she just put in his annual income for the last 3 yrs as $5-10,000 in the income tax area,also his w-2 for 08, but not his paystub, or the w-2's from 06 and 07.

I am freaking out that we will recieve a denial or an RFE as she put his income well under poverty line, even though he earns well above that. My husband is set to mobelize in the new year and I am expecting to deliver our son the 1st wk of Dec. Arrrrgghhh, i am very scared to be honest, and worried.

Any advice about this would be appreciated.

Things happen and people forget to send any tax records in or maybe half of their W-2's. You will get an rfe for that so just send your new info back along with the rfe letter and thats it. Nothing to really worry about, an rfe is something to be avoided but it isn't the end of the world.

You paid a lawyer that hired a paralegal that knows nothing about taxes. Big surprise.

You will probably get an RFE (you will not get a denial). Respond with copies of his tax returns AGAIN and proff of his tax exempt income. Fire the attorney.

Yes, people make mistakes. But people that charge thousands of dollars to use a $12.65 per hour clerk to do things ought to know better and ought to check the incompetent person's work before sending it out. If the OP made the mistake herself, it would simply be human error. In this case it is neglect and incompetence.

Yes, it will be sorted out with an RFE, the case will not be denied.

Yes, is it pretty sad when lawyers fail so bad and I do agree that the lawyer should be checking the work of a paralegal for the first few weeks. But lawyers are also busy preparing court cases and much more difficult cases. If a paralegal has just basic law training she will fail everytime. I don't understand why lawyers can't just improve their basic work... it would go a long way in having them stand out in a crowded field. When you pay for work you expect a certian level of quality, and sadly most lawyers don't meet that.

Thanks for the replies. If I was having an easier pregnancy I would definatly have handled all the AOS etc... myself. But alas, that is not the case. I guess the fact that I am usually very ####### about checking paperwork, I will at least have all finacial info on hand to mail in, incase we get an RFE. So far I do have to say that she and our lawyer have been great, their definatly not a back alley law firm, and have been very helpful and available to answer questions.

Here's to crossing fingers for an interview letter arriving soon.
