I have a cousin, who had gotten married in April. They filed the K1 Fiance Petition in March at the California office.

They received a notice that the case has been approved on Oct 7th, and the paper work is going to the Islamabad (in Pakistan) Consulate with interview date being scheduled in 2-4 weeks.

Notice I said they have already gotten married after filing a fiance K1 petition. Should they now file a K3 visa or just keep going with the K1 visa? What is the best thing to do?

Are there any shortcuts they can take at this time?

Your help is very much appreciated.

Ouch.

Their K1 petition is void. They will have to start again with a CR-1 (after sending a letter officially withdrawing the K1), and wait all over, and pay all the fees. No shortcuts available I am afraid.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The K1 path is no longer possible. Not sure why they did this, but they just wasted the $445 fee. They will have to start all over again with a CR1. What a waste.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

With a K-1 fiance you can not be married, and since they have already chose this route they have to go through with it, and give it a shot only if their marriage is not legally binding. If they are married religiously and their marriage is not registered then it may be ok. At the time of the interview if they ask the couple if they are married and the say yes, then they could be disqualified for the visa. I am sure they are aware of the consequences.

The only short cut is to pursue the k-1 as that is the fastest route. You could only qualify for a K-3 if your K-1 is not valid. Other shortcuts are if they called NVC and was notified that the petition has been sent to the consulate they can download packet 3 from the embassy and start mailing out the documents so they can get the interview date. Anyways, best of luck to your cousins

No you need to call NVC to get a case number and find out if they forwarded the petition to the consulate. Once it reaches the consulate then they can prepare for packet 3. Yes, packet 3 can be dowloaded from the embassy's website.

NVC is just the middle person who assigns a case number and informs you that they petition has been forwarded to the embassy. Sometimes they do additional background checks before they send the petition to the consulate in Pakistan. NVC does not mail out packet 3, but the consulate does this.

When is the right time to go ahead and download packet 3 and send it to the Islamabad consulate? After knowing from the case # that the documents have been sent by the NVC to the consulate in Islamabad?

Ok here are the steps. Please follow them in order.

1) Call NVC to find out if they have mailed out the approved K-1

and if they have find out the date it was mailed out and get the NVC case numer

(Note: this is different from the USCIS case number)

2) Call DOS (202 663 1225) and give them your NVC case number and they will tell you you if the petition has been delivered to the consulate

3) Once you get confirmation that consulate has recieved their approved K-1 petition then they can start dowloading packet 3 and mailing it out.

-They can wait for packet 3 in the mail if the want, but that will take longer.

For step 2 they can also call the consulate itself, and find out as well. But, personally I have gotten a quicker response from DOS.
