K-1 process with child?

Timeline

I need information on the K-1 process for a woman with a child. There is plenty of info on getting your fiance's paper work started. She will probably need to go to court to get full custody. But beyond that we need help. Do we need a passport photo of the child also? Any help is appreciated. Thanks!

4.4.3)...Are K2 children required to have their own passports?

A...In general, a separate passport is not required if the child is under 16. If the Consulate requires the child to have a passport, it will be listed on the OF-169 (or UK85). Many countries will permit young children to be listed on a parents passport, but at least consider getting a passport for your young child. You can avoid any problems dealing with INS upon entry, the young person can travel independently (if required), and the passport provides an identification document if you are ever separated for some reason. Besides, it will make a cool addition to the scrapbook collection when the child is an adult.

You do not file an additional form for the child. If the child is coming with the parent or will follow later, there is a line on the I-129F to list children. When you receive packet 3 from the embassy you will have to fill some of the forms (1) for your fiancee and another for the child. The child also requires a physical.

She will have to have custody papers and should have letter from former spouse allowing child to travel overseas.

I had to have a seperate passport for my daughter (im in UK and she is 4 years old)... because me and her father never marread, i just needed a sworn statement from him saying that Emily can move to the USA, to emigrate.

October: Waiting

November: Waiting

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

Each circumstance is different.

As my prior post said, I would recommend getting a passport for the child, however it is not officially required.

Example, my fiancee also has a child, she has never been married, the father provides no support and has little or no contact with the child. Since there is no prior agreement, no support, there is no requirement for her to track him down and get anything from him. (in this case he does not even live in UK).

The original question pertained to fiancee with former marriage and custody agreement. Each country and each embassy has different requirements. Again go get the passport and then is not an issue.

The father does not support or even spend time with the child. But, he likes to tell people he has a child))

He will not give permission for the child to immigrate. The child is 14 months old and he's seen him 2 times.

The child has the fathers last name and they were never married. So maybe this will be easier if it must go to court. They are in Russia and I am not sure about Russian law. I have read that he can come over with his mothers passport.

I would strongly recommend getting passport for the child. If you have it done no harm no foul. However if you get to interview stage and then they tell you for some reason you need it, it could delay everything even longer.

Also would definitly get the court thing straightened out with custody, will make things alot easier.

As far as getting the paperwork started you list the Child/Children of the fiance on the I-129f. The passport photo's are required as part of the petition only for you and your Fiance (not the children) G-325A Also only for you and your Fiance .. Full custody of the child in question would be a good idea but i imagine written permission from the other parent would also be acceptable ( please keep in mind i have not gotten to the interview process yet and i'm only guessing and relaying help i have found here ) The time is coming for me to find out soon though. Frankly i'm a bit afraid they will want a letter from my ex because i doubt he will make it easy for me .. I do have sole custody but our divorce agreement states he will have reasonable and generous access to the children and in the event we do not agree i will make the decisions and he can seek legal help ( so good luck to us both ) As far as an actual passport i would start getting that sorted ASAP ( unless you already have ) and keep in mind that some country's ( like Canada ) expect both parents to fill out and sign the application ..I hope this helps .. same like robin, i wil find out very soon if i have everything needed. i got full custody on my child, the father never wanted much to do with the child, but, i know, if i need a agreement, he will never give me, just to put me in a mess.. anyway, i will have the interwiev in 9 days. so far, they havent told me anything that i will need a agreement. the swiss law says, as long u got full custody on the child, u can go wherever u want. even if he has ( like in my case) visiting rights. i told the father, if he wants, we can make a agreement to change the visiting rights to holiday rights, so when shes older, she can visit him on her hoidays. will see if he is intrested. find out about russian law, and if she can get full custody, very important in ur case. as well, a passport. i got one since shes born. good luck!
