Hi Everyone,

It's been 2 or 3 months since I've posted a question here. My fiancee and her 2 adult children (18 & 19 ) have been living with me since entering the USA on Agust 3, 2009.

My fiancee is here on the K1 Visa, and the children have K2 visa's. My fiancee and I were married on September 4, 2009.

The three month date of my fiancee and her children being in the USA is quickly coming up ( November 3 2009 ), is this the date I am required to submit the adjustment of status requests by? The issue is financial. I want to submit the request for work authorization at the same time I submit the adjustment of status requests and the cost per person is $1,420.00 so we're talking a total of $4,260.00. I'm trying to see what if any flexibility I have; am I required to get the payments and paper work submitted by November 3, 2009 or if I have more time?

Another question relates to the 2 children. The children are eager to begin college studies, will they be permitted to attend college while they are waiting for their adjustment of status to be processed, or do they have to wait until they actually receive their green cards?

Thank you so much for any replies and information provided. The information provided here makes this whole very difficult process a little more tolerable.

There is no set time to file AOS, but the sooner the better - Once their I-94's expire, their status becomes "Out of Status" - not necessarily serious but it isn't protected either. Filing the AOS will protect their status (changing to "Pending" until the AOS is approved).

Another question relates to the 2 children. The children are eager to begin college studies, will they be permitted to attend college while they are waiting for their adjustment of status to be processed, or do they have to wait until they actually receive their green cards?

This really depends on the actual institution they are/want-to attend; typically they will need their PR/Green card but each can have their own requirements.

there is no timeframe as to when to file AOS , some do it a year after they get married but since there are kids involved I would advice the sooner you can file the faster you get the GC

the price is not 1420,0 it is 1010 that includes the EAD , advance parol travel document and biometrics per person

( unless they increased the price )

as to the question about the college am not sure if they are able to enroll , since you are out of status till you aply for AOS , maybe someone knows the answer about the college

k-1 AOS is 1010 - that includes the AOS itself, Advanced Parole , and EAD.

K-2 AOS is supposed to be less than 1010 ? I think your math is off.

re: 90 days window - relax - there is no official time window for when to file - only official time window of getting married (and you've gotten married within the time window already ).

if the 'college age children' are sneaking up on their 21st birthday - be careful - you could face a potential 'age-out' problem with subsequent deportation. The SAFE thing to do is to finish up AOS (card-production ordered 'time tick' ) before the 21st birthday.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

K2 AOS is only less if the child is under the age of 14 , since the kids are 18 and 19 he has to pay 1010,00 per person still better then what he tought 1420. ;)
