Using the list provided by Gary & Alla, I came up with our short-comings.

Joint bank accounts - we have one. A savings account. I do not work for a wage. Just what would I be adding on our behalf?

joint tax returns - got.

joint ownership of property - mother-in-law owns it. We pay maintenance, utilities and taxes . . . which are in her name.

cars - I drive my mother-in-law's car. I do not own a car. She can't drive it since the knee implantation so she added my name to the car insurance policy. There are 3 names on it: hers, my husband's and mine. He owns 2 cars---neither of which I drive. They are standard transmissions and I don't feel comfortable driving that kind of car anymore. The mother-in-law's car is automatic.

Joint leases - none. We pay cash for everything.

Joint insurance - health and car only. Health cards do not have my name on them---only the policy holder's.

Named as beneficiaries on life insurance - probably, but don't know. Never asked.

named as beneficiaries on medical insurance - ? Qu'est-ce que c'est?

Joint credit cards - don't have. can't get. we pay cash for everything.

Government documents showing common address

Driver's licence - yes, these will match.

Photos are good, kind of expected, but NOT primary evidence - we have these.

Children

- he has a son by a previous marriage. The son is 21 years old.

Utilities - in mother-in-law's name and she's not willing to change it and it would be too late now anyway (apply Jan24, 2010)

cards and letters from relatives - got these.

We are an older couple. We didn't meet until I was in my early 40s and he in his early 50s. We just wouldn't have joint debts. Even if he owned the house we live in---that would be it by now---he would OWN it, as in paid off years ago. He does not like to have debt and, in fact, has no credit rating as a result of always paying cash for stuff. I have no credit rating because I am not from the US (I am the immigrant).

We can also get the affidavits from friends, but apparently they're not worth anything anyway.

So . . . should I get ready to be deported?

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

The Immigration officer asked me if we would have children, I should have thought our ages would have shown that to be impossible except for a miracle.... and we certainly would have made the news being in our 60ies....

but seriously I would address some of the circumstances in a cover letter, they have to make the forms to fit one and all and obviously there are huge differences with couples in varying stages of life. I addressed our wanting to keep our financial agreements separate as I have sons and also the fact that I didnt acquire my hubby's family name but kept my own.

Most of all dont panic, but look at getting what you can, you can do it

edit ps the fact that I am a dependant, not working outside the home seemed to be a convincing factor too... obviously I wasnt only after a greencard,

almost 2 years ago USCIS scrutinized your AOS, interviewed your spouse and you, approved you, after which you got granted the status of a lawful permanent resident. That was it. Now, almost 2 years later, they just want to sort out the con artists who only married in order to get immigration benefits.

If you are still happily married, you will be approved. I met my wife when I was in my 40s, and I'm in my 52 now and she's 47. We have no debt either and I sent a total of 14 or 15 pages with my I-751, including the application itself and 3 pages of photos (3 photos on each page). I did not sent anything regarding the house (which I had years before I met my wife), not a single bank statement (only a letter listing accounts and balances), not a single affidavit.

It's not about the biggest package; it's only about a quick check. If you file jointly, you are almost approved already. I have seen not a single case where somebody filing jointly does not get approved.

So send them what you have, and you will be approved. It's really that simple!

Many, many thanks for your input. I need info like that. I, too, kept the name on my birth certificate.

Two years ago I applied for my Adjustment of Status and was granted a Conditional Permanent Residence card sans interview. There used to be a post somewhere in the forum back then that had a place to list your name if you weren't interviewed for AoS.

I do not know what a "beneficiary" on a medical policy would be. I am covered on his, yes, but I have never heard the term "beneficiary" used for spouse of policy holder.

By definition - a beneficiary is someone who does (or could) benefit from something - such as medical coverage. (The actual card may not show your name, but the policy itself would.) :star:
