My husband was previously married and we included his divorce paperwork with the K1 package. I am now (STILL!) assembling our AOS package to hopefully submit on Monday and I am wondering if we need to throw another copy of his divorce stuff in with the package. I know it doesn't say to do so on the guides however I've been looking around and I've seen that some people have included it.

Just wondering.

Also, does the affidavit have to be notarized?

Thanks!<3

Hi, no you don't need to include the divorce papers if he arrived on a K-1 - you won't need those again until Citizenship. What you want to do is provide evidence that supports the validity of your marriage, not prove that he is eligible to marry - that's been done. Some people get the affidavit's notarized, some don't. Both have been accepted. Affidavits are not considered strong evidence, though, so try to find good documentary evidence that shows how you are co-mingling your financial, personal and social lives together. Good luck.
