ok today i sent in my i130 .. thank the god , but i want to know when i send in the i129?

Why? The I-129 is a petition for an alien worker. If you mean I-129F for a spouse, please read a little here and you'll see the K3 visa is virtually obsolete. You'll probably be far better served by never filing an I-129F for a spouse. It no longer saves any time but it does cost more anc requires an additional immigration process after US entry.

Facts are cheap...knowing how to use them is precious...

You can send the I-129F the moment you receive the NOA1 for the I-130 back.

thank u so much for all responses and i know alot of people are doing cr1,, but i got friends whos husbands are from my husbands country and thier getting thier husbands here in 5-6 months on k3, and im not just talking about my vj friends, money is not the issue at this point, were confortable, we just want him here now.we will be fine untill he does he aos and gets his green card, but thanks for all the tips :luv:

You send in your I129f petition as soon as you receive Notice of Action 1 (NOA1) for I130 from USCIS. I would advise you too follow both routes, it doesn't cost anything more at this stage. If both petitions get approved at the same time, you'll receive NOA2's for both petitions.

As you read all the above threads, they are right I129f is more expensive in the long run, $1010.00 more expensive. But if you are like myself, you'll want to go with the fastest visa possible, regardless of expense.

When my attorney called the London Embassy, they did confirm that both petitions were being processed very closely with one-another. So we then decided to drop I129f and pursue with I130.

When your petition reaches NVC, it is then you ultimately decide on which route you want to follow. This is because NVC will ask for AOS and IV fees which is, $470 all together. Pending on your embassy they will send you a letter previously known as, "Packet 3"

"Packet 3" will entail you sending back the following forms:

DS-230 Part 1 signed

IV-15 & Checklist

Form DS-156

Form DS-157

Form DS-156-K

If your I129f interview comes before your I130 then you effectively loose $470.

File both route's for now then, drop the one you decide not to follow.

With unpredictably rare exceptions filing both petitions will result in approval of both the same day. HOWEVER, filing the second one forces the first one back to the second one's place in line, so the approval date is later than if you never filed the second one. Just say NO to any idea K3 is going to be faster in the long run unless you're going through one of those Consulates that treats the petitions differently after they arrive there, like Jordan or Vancouver.

I have been browsing the timelines for few posters in India and it does look like K3 is faster by about 1-2 months over CR1. A few people who have applied from Indian consulate feel the same way. I definitely agree that CR1 is cheaper and less hassle cuz you dont have to do AOS in the longer run but from the timelines it does appear that K3 is faster by 1-2months for India. Like the poster above advised I believe it depends on the consulates a bit to. So you definitely want to do more research on your consulate before deciding totally against K3. Again if 1-2months is not a big issue for you then I think CR1 is definitely the best visa cuz of not having to do AOS and alll the hassle later on. If money is not an issue then I think you should definitely research how the K3 timelines are for your country before deciding against it.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.

It depends on the constitute to be honest. Honestly, go with the one you think best. Have you got a attorney in USA? Another thing you can do it called the Indian US Embassy and ask them for an estimated time line for both pathways.

u send i129f as soon as u get noa1 for i-13 and u get it after 10-14days and dont forget to sent with the i-129f letter say u is k3visa and sent copy of the recipt noa1 cuz i already sent this and they didnt see it and give back out i-129f cuz they thought its k1 fiance visa and said we didnt sent check any way i just say that to make u not have the same fault wishe u good luck and if u needed any thing aske and i will try help u as i can
