Hi,

Once my fiance comes to the US on the K1 visa - will he be able to fly to say Hawaii or another US territory? What about out of the country - say Bahamas or Belize?

I am thinking of having a destination wedding but not sure where to go.........

January 8, 2010: Interview - Approved!

Hawaii is a possibility. Out of the country is not—the K1 is a single entry visa that requires marriage in the US. By leaving to marry in another country, your fiance would be ineligible to reenter on the K1, and you'd have to start all over again with an I-130 filing for a CR-1 spousal visa.

He will not be able to leave the US until he has an AP or greeen card, which will come sometime after the wedding. He can go to Hawaii as long as you go there directly and not enter any other countries on the way. US territories are also OK, buyt be careful that you go directly there.

The BVI's are a British Territory. If you marry there you will invalidate the K-1 visa and will have to start over with a spousal visa. The K-1 visa allows you to marry in the US only. Your options are to have a civil marriage in the US then wait for his AP to have a 2nd ceremony out of the country, or to have a destination wedding within the US.

I just found this post, it's sort of my same question so I dont want to start a new thread.

My I-129F was approved a few days ago, package is on its way to NVC so I want to start going over all the possibilities for the wedding.

I am puertorrican, moved to California a few years ago. My fiancé is Canadian. I have barely any family or friends here in California and to be honest, I rather spend money on buying a house than a flashy wedding since this would be my second marriage. Things would be so much easier for me if I could get married in Puerto Rico. I have plenty of resources to have a nice wedding in PR, not so much here in California but given the fact we are a US Territory, not a State, Im not sure if the USCIS will accept it. The process is a little bit longer and complicated than it is on the States. There's some blood work, marriage licenses and permits involved. I am aware of how that part works. I just want to make sure I can marry there. Last thing I want is to have my fiancé returned to Canada and have to start the process all over again because I didnt get the correct information.

I've searched the VJ forums and all Ive found are "guesses". Tried finding "official" information on the USCIS website without any luck. Ive also tried calling them but non of the menu options really take me where I need. I havent been able to talk to anyone at the service center. I am getting so frustrated. Feel like Im running around in circles. If I can't get married there well, so be it but at least I know I tried.

Is there any link from the USCIS out there that says it's totally acceptable to marry in a US Territory under a K-1? or is there number / specific option on the menu I should dial? should I just do an InfoPass and get an appointment at my local service center (which would be such a waste of time for such a simple question)?

I'll appreciate any feedback :)

You don't have to call anybody to ask. The terms of the K1 visa are that the marriage take place IN the USA, WITHIN 90 days of first entry. That rules out marriage before entry or marriage outside the USA. Get your head around those limitations as there's no getting around them without starting over again.
