Hi,

I am currently filing an Immigrant Visa (IR1 or CR1) for my wife. I am at the stage where I am waiting for the I-864.

Can she enter the US to visiting me using her B1/B2 visa while this process is at this stage?

I called the NVC to ask this question then they refered me to USCIS. When I asked the USCIS, they told me that they are unsure if US Custom would let her through. They gave me a run around and wasn't much help.

We tried this back in March. I went to Cairo and we went for a Visitor Visa for him, they will take your money for this fee for the visa and then just laugh at you and tell you be patient and wait for your other visa.

I even went to the main office and yelled and screamed at them for my flight to egypt for 1 week to do this visa after their suggestion for them to just laugh in his face and tell him to wait.!!!!

Anyway, it didnt do a bit of good. And we are just now going to the interview next week and still no visa yet....Hope we get together in August or maybe September?

So can the American citizen visit alien partner in their country ie can jeff come to visit me in Scotland while the visa is going through the motions?? He was planning on coming over in Sept.

yes the USC can visit their partner in their country.

Unfortunately, applying for a visitors visa whilst this immigration process is going on, in most cases (if not all cases) will result in denial as they know that you do have immigrant intent just by way of the petition you have filed. If, like the OP's spouse, they already have a visitors visa then it is up to the officer at POE whether to grant entry. As other members have indicated and by the link I provided, this can be done, providing if asked, one can show they will be returning to their country and still have ties, albiet temporary.
