hello,

I am a US citizen and am now in the process of asking for an immigration visa for both my wife and step son. We have been married 10 years now and my wife has been divorced since 12 years. In the judgement of divorce it is indicated, "the two parents have common parental authority of the minor and fixes his permanent residence at his mothers home." His father has be absence close to 9 years now with no form of contact(mail, e-mail, ext).

I have filing the i 130 from France and need to know if this will keep my step son from receiving his visa? Will the fact that his mother is coming to the US with me be enough or will we need authorization from his father that we have not seen or know where to find since 9 year? Note, that we do not want to ster up a hornets nest because though he has not paid child support in 9 years, the courts here take years for the littlest problem and the money does not interest us. We just want this move to be the smoothest possible. If any one can tell us what we need to do or know what the emassy will ask for we would be greatful for the help. PS-- We have all visited the US before and had not problems leaving the country but this is another process altought so....

It says in the custody agreement that they have common parental authority, likely permission from the father will be necessary for the child to move. Since this is not a visit and it's immigration, you'll need the permission of the father

I also sent a letter in with the I130's for the kids.

do you know what can be the solutions (if there are any)

my step son is more then 15; does that help?

can he have an other visa (student or i don t know) that doesn t need that paper?

If we can prove that he has been gone for over 9 yrs will that help?

one of the VJ members posted not long ago about a court document about custody HERE. See if it will answer your question, and if it doesn't I'd suggest to contact her through PM and ask her.
