i -130 provide affidavits

Hi

I am new to the forum site, my wife (US Citizen) submitted an i 130 on my behalf (British Citizen) to the US embassy based in London. We sent all the information required on the i 130 checklist but have received a letter which mentions the form has been found incomplete and/or requires additional evidence.

I have listed the items we are being asked to supply more information for along with my question(s) and would really appreciate if you can help us so that we can send the info they need.

1. Please provide a sworn affidavit that complies with 28 U.S.C. sec 1746. Explaining how and when you and your spouse met and the background leading up to your marriage on July 6 2009 (The affidavit must contain your full name and address, date and place of birth, the affiant may be required to testify before an immigration officer about the information contained in the affidavit.)

Does anyone know what this means in layman terms as we are both confused with we have to do or provide and what the format is?!

2. Please provide three (3) affidavits that comply with 28 U.S.C. sec 1746 sworn to or affirmed by third parties having personal knowledge of the bona fides of your relationship with the beneficairy. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship, if any, to the petitioner, beneficiary and complete information and details explaining how the person acquired his or her knowledge. The affiant may be required to testify before an immigration officer about the information contained in the affidavit).

Again, what does this mean in layman terms and what is the format?!

This is all completely new to us so we are pulling our hair out trying to figure out what to do here!? Also, is there anything else that would useful to send as part of the request above?

The affadavit for Item 2 is straightforward - it's asking for a letter from people who are certain that yer married. The format is straightforward, but the BIODATA on the PERSON probably will scare off MOST of the people who are willing to write one for ya.

Item 1 is also termed 'evolution of relationship' letter - many include it on submittal - you can search here for many examples.

I know this is all very confusing. Here's the deal... For the first part it's asking for a letter stating how you met your spouse and how you got married. The way I would write it is like a story... Tell the story of your relationship.

The second part is asking for three affidavits from friends/family attesting to your relationship. When I asked my friends to write one for me I basically asked them to write about my relationship as if you were telling someone who doesn't know me all about the love story you've witnessed. I had one friend who wrote a very short simple one and two others that went into significant detail about what they've seen. The first paragraph was just them stating who they are, where they were born and where they live.

I would have both notarized if you can!

Thanks New Beginnings, on my first point, if I am writing a letter on how I met my wife, what does it mean by "The affidavit must contain your full name and address, date and place of birth, the affiant may be required to testify before an immigration officer about the information contained in the affidavit." Does that then make me the affiant and I would have to testify against my own statement???! As my wife is the petitioner does she need to write a letter too or would one letter about how we met be enough from either my wife or I?

Do you have any examples of what point 1 and point 2 looks like?

FWIW, I prepared BOTH sets of stuff for the initial I-130 submittal for my wife. The blue slip you've received has some verra nasty and legal language in it, but totally gets transcribed to what I said in my first post here.

These documents do not have to be notarized as they are asking for sworn affidavits. You must include the proper language (typically at the end of each document) where the author is swearing/affirming that the information contained is true and complete to the best of their knowledge.

The USC is the person submitting the affidavit. They should give a story that includes the meaningful/important dates and events in your relationship. For example: events such as time together with friends and each other's family are good to include.

The affidavits from friends are not where people say how much in love you seem to be. It's about them telling about their interactions with you as a couple.

If you are not sure how to begin try making a list or outline of the "big" moments in your relationship. Once you have the topics to be included write your story.

My petition was approved with 2 affidavits..They are not explicitly demanding for # of affidavit but since it says "AFFIDAVITS" in 130 requirement, I assumed it was more than 1, at least two..

I had to wait more than a minute. To be precise it was 62 days before our 130 was approved but certainly not due to # of affidavits, I'm sure..

Hey - no worries. In my case, this stuff wasn't free :( The affadavits from China had to be translated into English at a notarial office, with official chops and atamps - I paid 200 rmb each letter. Not so bad, really. I think I did overkill, but I wanted to be 'complete' on the I-130 submittal.
