Some questions about the next steps towards K3 Visa

Hello All,

My husband and I are in the process for his K3 Visa, he is Finnish and I am American.

We sent in the I-130 and G325A a little over 2 months ago and we just received the I-797C stating that our I-130 has been approved and is now being forwarded to the National Visa Center. Apparently we made the mistake of not sending in the I-129F immediately after we sent in the I-130 as we just got everything together for the I-129F and sent it in only to have it returned for the reason their records indicate the I-130 is no longer pending. According to the Embassy in Finland that means we have to wait the normal 18 month processing time now and we are so frustrated we truly have gone through forums, the directions for the forms, emailed both USCIS and the Embassy and are still lost as to what comes next. Has anyone else been in this situation or could anyone give us advice as to what comes next? My issue is when I have called the appropriate departments to get answers to our questions I am often given the run around, or am just read the same script I'm looking directly at online when it comes to directions for the forms. I understand the directions I just don't understand what comes next.

As far as we are aware we are to wait the 90 day period from when we recieved the I-797C to be contacted with an appointment for his Biometrics exam and then after that some more paperwork and interviews.

I'm just wondering if that will stay the same now that we had our I-129F returned :/

Please take it easy on me as far as any feedback this is my first time posting in any type of forum period and this is all new to me!

p.s. at this point in the process would it even make sense to attempt to get an immigration lawyer?

Who at the embassy told you that there was an 18 month wait? And what exactly were they referring to? Are they saying the wait for an interview is that long? I'm almost certain it's not. Are they saying that's how long it will take to complete the rest of the processing? Because the embassy has basically nothing to do with it. You're with NVC for the rest of it, they just accept your file for the interview.

As for the rest of the processing, you seem a bit confused. There's no biometrics done at this point. Read through this: http://www.visajourney.com/wiki/index.php/..._live_in_the_US

Hi aholmby, Lots of things have changed since I first applied it looks like. I'm confused because you don't have a time line yet and that would help others to determine where you are at in the process. How long have you been married? From the information submitted I wonder did you apply in Finland or stateside? From what it looks like since they rejected the I-129F because of an approved I-130, which I've never heard of before so this is a first, then that means you are on the CR-1/IR-1. I am guessing since the letter you received instructed biometrics that they do that up front for Finland before the interview.

I would suggest making an info pass with your local immigration office to go in there and get some information on your process.

Your 130 was approved in two months? That is a BLESSING!!

dont worry about what the consulate told you, they have nothing to do with this next step(thru NVC). Your 130(CR1) will process thru NVC and you will receive instructions soon on the next step there...follow those and check the guides here and you will hopefully get through NVC quickly and have an interview set up by them(NVC) at the consulate in Finland

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.
