I am ready to file I-864 AOS form, but I am currently unemployed, would that affect the case and lead to an automatic decline? My brother who lives under the same household, would file I-864a to help me, would that be enough? I do some part-time work but it is by my own, and I get paid in cash and not reporting to irs yet, would report it next year though.

Any comments of possible options that you guys see?

Would been unemployed decline the petition?

Please advice!

As long as you have a co-sponsor who makes 125% above the poverty line for the 3 of you, you should be OK... They dont deny it, just ask for additional proof/sponsor... Does your brother make enough? If not, then you will have to find another sponsor... Make sure you follow the guides on using a co-sponsor (identification, proof of relation to you like birth certificates, and the proof of income (tax transcripts, employment letter, pay stubs)...

If so, then you should be fine... Just get all of your evidence and info together

Yes I would agree 100% with Christeen

I have been unemployed and at the time of my husband's interview everything went well, except for the fact that i was unemployed, the officer was nice and everything but they ask for a co sponsor...

They won't deny it, and they will give you time to find the joint sponsor but make sure that person makes enough to support and shows proof of relationship to you..

What happens if you're collecting Unemployment Insurance that exceeds the income requirements and you have a statement showing it's good for a year?

When I called the USCIS they said U.I. was accpeted as income but now I'm reading conflicting information that having U.I. benefits during the interview process may not fly?

If you made it to the interview that would mean the original AOS petition was approved and your K1 has a work permit. So by the time you interview K1 could have a job and you don't?
