Once your fiance' arrives in the US on her K-1 visa what is the maximum legal time you can wait before filing for AOS?

90 days is the time your i-94 is valid and the time you have to get married. I don't think there is a maximum legal time by which to file for AOS. It's best to do so as soon as possible after getting married. if your I-94 has expired and you haven't filed for AOS, you will be out of status until you file for AOS.

If the AOS is not submitted by the time the I-94 expires, you are out of status and deportable. An application for adjustment of status will still be accepted any time after that, but you are not in a legal status in the interim. Delaying the adjustment puts the beneficiary at risk.

What is an I-94?

It is the form attached to your passport at the POE that indicates the period of authorized stay. For K-1, the authorized stay is 90 days.

The official at your POE will either give you the form to fill up or direct you to a counter where they are. You fill it out and give it to the officer who stamps it and staples it to your passport.

It is valid for 90 days.

You must get married in this 90 day window. Or return home.

If you want a drivers license or SSN card you must apply at least 30 days BEFORE the I-94 expires. At least here in Iowa that is the way it works...

For the SSN card you also must show your marriage cert.

As you can see, you got to really move fast to get married and get the cert. back, before the I-94 reaches the last 30 days.

You can, of course, wait for your EAD or Green Card and then do these things but I was so darn tired of waiting all the time...

You get the EAD and GC from your AOS application. Which means another 90 days 120 days of waiting...

Not true. If you get married after the 90 days, you will have to submit an I-130 petition with your AOS package. You only have to leave if you don't ever get married to the K-1 petitioner. However, you are out of status at the end of the 90 days whether you got married or not.
