I'm a US citizen and I'm planning on bringing my wife here on a K3 visa (from India). I just filed for her I-130 green card petition on October 6th (that's when they recieved it according to registered mail receipt) and I noticed that they drew out the $355 out of my bank account today (14th; incoming check; I know they dont send the check back and just electronically draw it out of your account). So that's a sign of acceptance of my petition, as I understand it (from all my reading online).

Question is this - for now filing a K3 visa, the application says that you have remit $455, but says its no fee if filed after the I-130 fee increase. Question is, should I include a check for 455 or not? Thanks

04-29-2010: INTERVIEW ASSIGNED FOR JUNE 10TH IN CHENNAI CONSULATE, INDIA; 06-10-2010: INTERVIEW - VISA APPROVED!!!!!

There is no fee when filing for a K3, that $455.00 is actually for k1 VISA a ficance' visa.

Tip: Dont file for K3, will slow you down, and is basically obsolete!!! Not worth it at all, and will cost more money $1010.00 to adjust status once she is here.

While the CR1 is overall a better option, I wouldn't go as far as saying the K3 will slow you down. I did a quick search of the timelines for India & K3. The average time was 208 days. (I looked at NOA1 dates after Jan 1, 2008). Using the same dates, the average timeline for the IR1/CR1 was 289 days. Using these stats, the K3 was about 2 2/3 months faster.

Again every case is different and there isn't enough data to see if the CR1/IR1 is getting faster (or K3 getting slower), but based on these numbers, I definitely would not say that the K3 is slower.

Did you do a quick search to see how many K3's were put into AP at NVC? and how long there were in AP? Many people going K3 ditch the CR1 and followed K3 thinking the beneficiary woudl be here faster, boy did they get a surprised, waited in AP, finally got out, went to embassy and got crappy K3 visa then turned around dough out $1010.00 and filed for adjustment when in USA. All to save maybe 1 month in the process.

The historical timelines are a poor measure due to many flaws. In actual practice today, filing the I-129F for a spouse causes the I-130 to lose its place in line and go back to the priority date of the I-129F filing. Just sticking with the I-130 from the beginning avoids that. The historical timelines currently include lots of people who filed I-129F petitions and then later wised up and followed the CR1 path.

All the shouting was just a bit of feigned frustration. Obvious to anybody following along, K3 being virtually obsolete consumes the majority of discussion in the K3 forum. A little reading will prove that to anybody with half a brain.

Facts are cheap...knowing how to use them is precious...

thanks for info. Yeah I figured that out after going thru the fee forms that there is no fee. Seeing that there is no fee, it doesnt hurt to apply i figure. After doing quite a bit of reading and also talking to immigration lawyers, apparently the k3 process has sped up from 3-5 months. Just out of curiousity, is the fact it took them only 8 days from receipt to approval mean that things have sped up and gotten a little better? i estimate that once i know my case #, it should be easy to follow the case online. does anyone know if they post the NOA online on the case tracking service that they provide at the USCIS website? can one just print out the NOA (say as a pdf) rather than wait for it in the mail?

Yes, it can hurt to file the I-129F for a spouse. Anybody following what's actually happening has known that for more than two years. JUST SAY NO TO K3!

It can and does hurt your file. When we applied K-3 petitions were being approved 6-8 weeks LATER than the stand alone I-130s (I sound like a broken record)

I went the K-3. we did get stuck in a AP at NVC on her K3 for about month. I did the CR-1 also and got to the part where I had to pay the AOS Bill then my wife got packet 3. I call my congress man's aid and she called the NVC. They both say at this point of time it would be fast to go with the K3, the NVC are backed logged on CR-1.

My main reason is I wanted to be with wife and son for Xmas. The NVC felt my wife would not get her CR-1 by Xmas.

so what was best for me !! pay more for a K3 and AOS or pay for a Airline ticket.
