help!!! Confused about SSN 194 and AOS

Help!!! My husband and I just filed AOS. HE came in on a k1 visa and the I94 is going to expire at the end of the month. I thought we had to wait for EAD to apply for a SSN.

So, we filed the AOS paperwork last week. I read a post that the SSN office won't issue a card if the I94 is ready to expire? Did we screw something up? Can we still apply for SSN? He only has a copy of his birth certificate also, will that suffice?

No - could have applied for it shortly after entering the US.

So, we filed the AOS paperwork last week. I read a post that the SSN office won't issue a card if the I94 is ready to expire?

Yup - if it has less than 14 days remaining (if you've got an SSA office nearby, might be worth a trip to find out).

Did we screw something up?

Not really, no.

Can we still apply for SSN?

You'll may have to wait for the EAD to come in to apply .

He only has a copy of his birth certificate also, will that suffice?

Needs his passport with I-94 in it.

Yup - if it has less than 14 days remaining (if you've got an SSA office nearby, might be worth a trip to find out).

Another question?? If we go to the Soc Sec office today what do we mark on the form? Legal Alien allowed to work?
