get your passport and file the amended returns.

if you absolutely refuse ot do that, look into the requirements for a state ID card in your home state, but i'm pretty sure you'll need a passport for that.

Well I need the green card for state ID, and I need a GC or passport or SSN for taxes, but as far as i can tell, I don't need a passport for AoS.

You do need a government issued photo ID though, for various steps in the process, e.g. biometrics.

The thing is that I did have one when I came trough. Canadian Medical Card, but it's expired tho. You'd think that, if I'm adjusting my status after being out of status, it would make sense that I don't have any other IDs.

Plus, I will be providing like 3pictures with the package.... Or, I could always wait till I receive the EAD and use that to get State ID... Can the deliver EAD without biometrics?

No, the EAD requires biometrics.

You really should contact the Canadian embassy/consulate and see if they will issue a passport. It will really makes things easier.

Seems like it's going to be a problem. Is there anything else I can use? As I've said, the only other ID I have, with a picture, is my health card, but it's expired.

Maybe something certified?

Did you try to get some form of ID from Canada?Do you have your birth certificate?

I'm sorry you have such difficulties.

I have a birth certificate, SS Card, and expired medical card.

I'm trying to get hold of the DMV, see what they say.

This one woman was arguing with me, saying I have to have an I-94. I was like "no, I don't get one as a Canadian"... Wouldn't budge. :wacko:

hi,

I don't know in what state you are living, you can check online the DMV requirement to have a ID card.

In NYS for example, to check your identity before AOS, you need a picture ID card, but you can have it only with your passport + I-94, I don't know for the case of canadian or mexican people who don't have the I-94.

But the passport is mandatory, it is NOT an option. If not no ID card.

After receiving your GC, the ID card replace your passport in USA. No way around.

Your Birth certificate is not a ID certificate

Your USSS (US social security card) is not a ID certificate - that you don't have it seems me???- for that you need your passport +I-94 also (maybe it depends on the state also)-

I don't think that your canadian medical card is considered like a ID card, maybe when you entered in USA, but USCIS or DMV have spefics requirements.

Passport with I-94 (for some purpose it has to be valid)

But all things start with a passport.

I did some mistakes in my post

I don't know in what state you are living, you can check online the DMV requirement to have a ID card.

No way around.

So your only solution is your foreign passport to prove your identity.

Yup. I've looked into Canadian Passport, I just need to find someone who can act as a Guarantor and I'll be set.

Bold/underlined part true in Tennessee. My daughter 2(22 yo) went today to renew her TN DL and was asked for her BC. She had to return home and get it.

Since she got the first one as a 16 yo the rules have changed. You have to prove you are in the US legally, even for citizens.

If you do not have a guarantor, you can use a form called 'Declaration In Lieu of Guarantor". Here is the link to the information at Passport Canada.

You can request Passport Canada to send you the form by mail, or you can contact the closest Canadian Consulate and see if they carry the form, or you can use the old passport application with the old guarantor form and that way your current doctor or minister or someone who fits the Guarantor Guidelines - even here in the US - can act as your Guarantor.

Yup, I am keeping that as a last resort. I cannot use my medical card, because it is now expired. So I am using a Birth Certificate combined with a SSN (the one with a signature in the back). They usually require a picture ID, so this is kind of an exception. If I try to use a "Declaration In Lieu of Guarantor", it's going to be a second "exception" and they might deny it. If I cannot find a Guarantor, then I will try with it.
