Ok. A small rant here. I finally get around to going to HR Block to get an ITIN. Apparently, to get the ITIN, I need a birth certificate (which I have) and another piece of ID (the only one I have is expired). Now, at this point, it might just be desperation talking, but if my name is one nearly everything, house, bank accounts, cars, bills, utilities.... but not on the tax return, will that be a huge deal?

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

Ok, after a few phone calls, I can say with certainty that I cannot have a passport. No passport, no ITIN, no ITIN, no taxes. If everything else we have has both our names, and if I get our tax lady to write up a note and notarize it, will this be an issue at the interview?

Let say I submit the paperwork for AoS. Provide proof they require, accept Taxes. Then accept my paperwork, send me an EAD. I use this EAD to get a SSN, correct my taxes... Present those at the interview... Voila! Would this work? Or am I delirious?

Just bring everything you could, you dont have any other choice anyway. If the tax issue comes up at the interview, just try to be honest and explain everything. You should be fine.

Im sorry i didnt realize you still havent filed your AOS package. In that case... u still have time to fix up your taxes in time for your interview.

Yup, I think that is what I'll have to do. Hopefully, they will accept my AoS package without the taxes. I figured if I can send them other kind of paperwork, they'll take those instead.

I think her spouse filed 2007 and 2008 as single or Married Filing Separate -- doesn't make the relationship as "real" in the USCIS eyes.

OP - not sure why you have been here 2 years and don't have a SS? Guess you didn't come on a K-1. And our bank required a SS # to add my husband to the account.

I'd send what you have and amend your returns once you have your SS #.

At least one prior year's tax transcript (or photocopy of return) is required to be sent with the I-864. If you don't send any tax information, you will get an RFE and your application will be held up.

I think what she meant was not being included at her husbands tax transcript.

Hey kittyfang... What we did was send my husbands 'single' tax return forms from the last 3 years for the initial pacakge and then once I got my EAD, go to get a SSN asap. Didn't take more than a week to recieve it, then we were able to refile my husbands taxes for the last three years 'jointly'. Mind you this was a week before our interview, doesn't take long and you get the proof right away! Our IO was pleased that we were able to do that! So don't worry, I'm sure you'll be able to refile before you go to ur interview!

At least one prior year's tax transcript (or photocopy of return) is required to be sent with the I-864. If you don't send any tax information, you will get an RFE and your application will be held up.

I think what she meant was not being included at her husbands tax transcript.

That's it. My husband was advised, wrongly, to file as a single man since I didn't have an SSN. We will send his tax papers (as well as our co-sponsor since we will be needing one). I will write up a note saying that the tax papers will be changed once I receive an EAD.

Hey kittyfang... What we did was send my husbands 'single' tax return forms from the last 3 years for the initial pacakge and then once I got my EAD, go to get a SSN asap. Didn't take more than a week to recieve it, then we were able to refile my husbands taxes for the last three years 'jointly'. Mind you this was a week before our interview, doesn't take long and you get the proof right away! Our IO was pleased that we were able to do that! So don't worry, I'm sure you'll be able to refile before you go to ur interview!

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

Go to the next Canadian embassy and apply for a passport ASAP. Once you have it, take step 2.
