The real question is What is your income up to the end of September 2009, and how much you got in the bank now?

Are you currently employed? Are you making enough? If not, you will need a co-sponsor, either a USC or a LPR, related or not will suffice.

You are never required to meet present guidelines wioth past income. One years tax return or transcript is all that is needed. That will be 2008. There is no benefit in your case to provide three years. What is your current annual income? Can it be documented with an employment letter, check stubs and /or bank deposits in the past 12 months?

IF you started a new job yesterday making a salary of $45,000 per year, then your CURRENT annual income, today, is $45,000 per year and you do not need a co-sponsor if that current income is documented.

first of all , thx for the answer

i agree with u that there is no benefit to provide 3 years , only the last year of 2008 ,but according of form of I-864 (item 25 ) we have to write the last three years income !!!

yes i will get the deposit for the last 12 months from the bank , is that gonna work to show my annual income for 2009 ? i did not keep my stubs for the last 12 months !!

thank u in advance

Yes assets count but only on a 3 to 1 ratio...so $5200. is gonna equal about $1700 meaning if you have income of $16,600 and add the $1700 you would be at $18,300. right over the poverty.

You still never answered what you income is up to now this year...on your last paystub what was YTD.

i have the same problem with the consular stage and i want to use our assets to cover the gap between the household income and the 2009 povertt guideline , what kind of bank statement do i need ?? a certificate from the bank shows how much do i have or a bank statement shows all the transactions through the last 12 month ?? my salary is being transfered every month to the bank but i had no savings because i was using my money in some business , now i collected all the money and deposited them last month to qualify ...will that make a problem ??

How about getting an employment verification letter from your Human Resources Dept stating your position in the company, full time permanent work, how much you make per month or per hour or per annum (whichever) and how long you have been working there. If possible can you have them print out a statement of your salary indicating how much you get paid each month for the last 6 months (since you didn't keep your paystubs)

My husband business was really bad for 2007 and 2008 (loss) and the end of 2008, he started working for the county's Sheriff's Office. Now, he makes way more than the required income for I-864. So he just submitted his 2008 tax return (not pretty numbers), his electronic paystubs for the last 6 months from the county to show that he makes enough to support both of us and an up to date employment letter from the Sheriff's HR, that's it. We did not submit the bank statement or assets. (we don't have any assets)

Hope that helps and wish you all the best!

Cheers.

Yes, on the I-864 you need to write in the income for the last three years, you do not need tax returns. And what? As stated, the past three years mean nothing, you qualify on current income.

Bank statements (a bank letter is better) showing deposits for the last 12 months will SUPPORT what you state your current income is. If you say your current income is $40,000 per year and you show me a bankl letter saying you deposited $38,000, or $45,000, I am going to believe you. If your bank letter says you deposited $12, 400, I am not going to believe you. If you are self employed, then bank statements and deposits can act as "check stubs". If you get paid cahs and have not depoited it...you are screwed. If you have been keeping half you check payments as cash, depositing the rest and not keeping your check stubs...you are screwed. You are in a process that requires you to keep records of everything for the next couple of years (for at least two years after your wife gets a green card) so you better do it.

If you cannot do this, then you need a co-sponsor.
