I129F approved, File not recieved yet 4 CR1

Hello everyone,

We got approval for both I130 and I129F, we got a letter today saying case will be transfer to spouse outside the US. And we've been calling the NVC but we keep getting no file received yet meaning we dont have a case number yet and we haven't given them our emails address. Please how can we still go back to the CR1 path because thats what we really want now.

How can we stop the I129F and get our file to be at the NVC, and be able to get the case number and the DS3230 through his email address

Oh in the Letter we got concerning the I129F transfer to outside US they already assigned a case number in dat one...we dont understand all these. Anyway help will be valuable at this point

Don't worry too much. If both your I-130 and I-129F got approved, then your application for CR1 and K3 are both rolling at the same time. There is really no need for you to "stop the I-129F."

Your I-130 has probably been received by the NVC. However it will take them some time because they'll need to briefly review your case before issuing a NVC case number. After they issue a case number, NVC will send you more instructions regarding your CR1.

It sounds like NVC has already issued the case number on your I-129F. They've sent the application to the Embassy/Consulate for processing. You will be dealing w/ the Embassy/Consulate for the K3 from now on.

In the meantime, have you gotten all the documents you need? Police certificates, tax returns, etc?

NVC "touches" your I129f case long enough to assign it a case number; then forwards it to your constitute. You Embassy will then communicate all paperwork they need from you to progress the case via mail. SOme embassy don't even issue what was known as "Packet 3".

I-130 the NVC will deal with that. I think you just call NVC and tell them to drop the I129f, if the route you want to follow is CR-1 (-130). Yes, I agree with celiothrkn, concentrate on getting your originals documents over to your spouse in USA:

Police Certificate

Wedding Certificate

Birth Certificates

Proof of US Citizenship of your spouse (just in case)

Spouse Birth Certificate (just in case)

W2's

I-864

Joint sponsorship - if applicable.

Get money together to pay AOS and IV fee's they ask for it.

The letter you received regarding the I129f, the case number, that is the case number your embassy will follow. You get a case number for I129f and I130, they are different though. When talking to NVC, you quote them the case number they have assigned your case, not the receipt number USCIS gave you.

Make sure NVC has all the email address, your, spouse and attorney if you have one.

If your going to follow thru with CR1 , IGNORE all communication with embassy on the K3 then.

You should get a NVC number soon for your CR1, same thing happened to me.

Thanks guys, i even called the NVC after posting this issue, i gave the operator the Receipt number because apparently she asked for the case number and i said we dont have it yet and thats why i called. she checked and said they haven't receive it that i should give it 2weeks and call back.

And yes i have all the document expect the DS3230 which i believe i need to get from the NVC via email, my question now is can i send all that now while still waiting for the case number and no DS3230 yet?

I asked the NVC operator about the I129F and she said there is no way to stop the I129F all i can do is when the embassy call i should tell them i want to go for the CR1 so ill wait.

Feel free to send all the other DS-230 supporting documents to your wife while waiting for the DS-3032 for an NVC case number and the DS-3032 to be generated. Your wife will need to be sent these documents anyway so no need to delay. Once you receive the DS-3032 from the NVC, you can fill, sign and send back to the NVC.

9/04/09 - Received email with approval (NOA2)from CRIS at 11.30pm!-Good start to labor day weekend

9/12/09 - Received hard copy NOA2

9/22/09 - AOS and DS-3032 received by email

9/22/09 - Sent DS-3032 by email

9/23/09 - Sent DS-3032 by mail

9/23/09 - Paid AOS Bill

9/28/09 - AOS shows as paid on NVC (printed cover sheet)

9/30/09 - IV Bill generated

9/30/09 - IV Bill paid

10/1/09 - Returned AOS package to NVC

10/1/09 - IV Bill shows as paid on NVC (printed cover sheet)

10/2/09 - Returned DS-230 package to NVC

10/3/09 - NVC received DS-230 package-Unofficial(express mail delivery)

10/8/09 - NVC recieved DS-230 package - Official (Under Review)

10/14/09 - NVC Login Failed

10/14/09 - Case Complete

10/30/09 - Case left NVC

12/23/09 - Interview Date

12/23/09 - Visa Approved
