2 years greencard holder (wife the petitioner just died}

my sister died today, she was married for 30 months and her husband is from ireland. his greencard expires in may 2010 and he has to apply for his new green card in december 2009.... with his wife , my sister dying what can he do to have the new green card issued and not have to be told he has to leave the united states and return to ireland...advice are truly appreciated,tnx..

First, I am sorry for your loss.

Your sister's husband can file for removal of conditions on his own, the instructions are in the 751 instructions. He can do this at any time.

i know its not time to talk about it,but my husband and i just trying to help my sister in law's husband..He is a nice man,great husband.My husband and the siblings want him to stay here in US.Am asking your advice,plzzzz..thank you

Yes, your brother in law can stay in the US. He needs to file form I-751 to remove the conditions on his green card and get his permanent card. On the bottom part of the form he will check off that he is filing for a waiver from the joint filing condition due to the death of his wife. He will include evidence that shows the validity of their marriage and include a copy of her death certificate. He doesn't need to wait until December to file. He can file as soon as he has the documents he needs together. I doubt he will have any problems with getting his 10 year card.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

My condolence to you and the rest of family first. Your brother-in-law is protected under the US immigration laws as spouce of a US citizen for more that 2 years and also for being a permanent resident. The only thing is that, instead of the 3 years waiting to become a US citizen, he will have to wait 5 years. He is ok... he can file to have the conditions removed on his own.

thank you so much guyz...the family is really in pain,sad and thankful at the same time that god took her and have everlasting life and feel no pain because of cancer!!!

08/21/2009 - AOS package sent

08/28/2009 - NOA 1 for AOS, EAD, AP

08/31/2009 - Cheque cashed

09/05/2009 - Biometrics notice received

09/23/2009 - Biometrics Appointment

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)
