Affect of annullment/name change on K1/K2

Hi,

My fiancee has 2 children and an annulled marraige. We wants to change her name back to her maiden name for the visa process

but leave the children with their fathers last name. Will that cause a problem in the K1/K2 process?

What is the experience/advice of forum members with regard to name differences between the mother and children?

Why confuse things more?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I did not change my married name back to my maiden name when I did the K1 process because all of our evidence had my married name in it (plane tickets, boarding pass, passport, hotel folios, driver's license, etc.). I did not want to confuse the adjudicator at USCIS.

A

No it will not. My fiance did just that and we just got our NOA2. Her son still has his fathers last name, but we will change it to my last name after arriving in the US.

Nothing,the only difference is that,they will have different last names :star: .I also had my 1st marriage got null and void,I went to DFA to have my last name on my passport be changed from married to single again. My son and I had different last names,it never had any effect during the K1/k2 process,neither at our point of entry.

When a marriage is annulled, the kids retain their dad's last name, unless you adopt them. And you can only do so if their dad relinquishes his parental authority over them or if he passes away and your fiancee allows you to adopt them.

On your forms, your fiancee is supposed to indicate all of her names (as a married woman and as a single woman). An annulment is a legal document that allows her to change her name back to her single name.

She would need her IDs to reflect her single name, the main one would be her passport and at least one more ID that has her picture and signature on it.

She also has the option to keep her IDs as is if she does not have time to change them.

Whatever name appears on her passport must appear on the K1 visa.

At the airport, prepare the documents she would need to present to officials who see that she has a different last name as her kids (if she does manage to have her IDs changed). There shouldn't be a problem.

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

hello, i am processing my case too, and after this, my name will be change again in my single name and my son bcoz my case is null and void too... sooo happend that the father's name registered in my son's bc is the wrong name too of his father, so my son will be in my maiden's name too.... :star:

Hi, my marriage was annulled. I changed my surname to my maiden name however, my children retained their surnames. With a copy of the court order , finality, annotated marriage contract and letter request/ or the forms for change of name, i applied with the different government agencies like the PRC,GSIS,HDMF, Philhealth, my employer and all other institutions i have business with, for a change of name. The PRC issued the new license after 3 months,the HDMF made the changes right there and then, all other agencies effected the change in a matter of month. The NBI clearance and passport were also issued in my new name. I even secured a SOLO PARENT ID from the DSWD to show proof of my relationship with my children who has different surname from mine(of course, thats aside from their birth certificates).
