Hello,

I am a naturilized citizen, recetly filed a petition for my parents and my baby sister (17y.o) who currently reside in Uzbekistan. I received an approval for my parents, I-797 but did not hear anything about my sister. I included her in petition of my parents (on each petition, my mother's and my father's) and thought she will be able to immigrate with parents( I did file separate petition for her as well). About a year ago, I called Dep. of State to inquire about this process, was told she should be included and also it is up to consular offie abroad to determine that. Now when I call them all, DOS, NVC and consular abroad they all say one thing-no, she is not included and have to wait for visa availability- which is 10-12 years!

I told this news to parents, we're all very upset about it. After 8 years here I was really hoping to see them all together. I don't know what else to do. NVC advised to have my parents file a petition for her after they arrive, which will take a little less, about 3 years. My parents are in their late 50's and they're not in great health to jump from side of the world to another. Please, advise what else can I do?

Note: My parens applied for visitors visa several times, within past 8 years, no luck. Knowing that I don't think they will let my sister on a visitors visa...

There's nothing you can do about your sister but wait for not only her petition to be approved but also for a visa number to become available. She does not qualify to get a visa along with your parents since she's your sister and falls in a different category. So, legally there's nothing you can do to change that.

Your sister will be category 4 (Fourth: Brothers and Sisters of Adult Citizens). According to the timetable below, they are currently processing cases that were filed on June 15th, 1999. So it will take approximately 10 years for your sister's visa to become available.

Once your parents get here they can get USC in 5 years and petition your sister. It will be faster then.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

What about F1 visa, what are the chances of her getting student visa to go to school here? At least she'll be with us...Although some people think she will not be able to obtain it, due to the fact that I am a citizen and petition is pending on her behalf. I guess consular sees it as intention to imigrate..

That may be the case but you won't lose anything by trying. I personally know of one case where a K2 visa was denied because the child of the beneficiary was over 21 years of age. They then went for a student visa for him to learn English here in the US and the CO never asked him about his previous denial. So it's worth a try even if it's not guaranteed.

F1 will not be cheap and it is a non immigrant visa.

Another option would be for your parents to wait until your sisters visa number comes up.

You mention health issues, what are you going to do for your parents? Do they have jobs with insurance lined up?

You might want to look at the costs....

It sounds like you have just assumed.
