The 38.4 months is the timeframe for getting the I-130 approved... the rest of the time is waiting for a visa to become available. You need to check the State Department site for the priority dates for visa numbers being issued to the different catagories. http://travel.state.gov/visa/frvi/bulletin...letin_4576.html

I see okay, when entering in my case number on the uscis website it says my applcation is on 'Post-Decision Activity'. The letter i got back in August last year stated the application had been approved so how long would you say I have to wait?

Your wait time will depend on your visa catagory and what country you come from. Without that information I can not help you.. you could fill in your timeline and your profile that would help people give you the correct information..

I really get lost in that DOS site, by entering in the WAC number, get this.

"On September 29, 2009, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN." An unmarried over 21 son in Venezuela. We got the NOA from CSC that last month was 60 months processing time, today it's over 92 months. Can we believe that?

If you could help Tay, would appreciate it.

USCIS bounces around processing dates like a crapshoot.

"

USCIS National Goal - 5.0 Month(s)

ptGraphNatlAvg.gif USCIS National Average - 49.8 Month(s)

ptGraphLocal.gif California Service Center - 92.8 Month(s)

There goal is 5 months, national average is 49.8 months, CSC is 92.8 months? The can't even do averaging math.
