October 2009 K-1 Visa filers

I'm starting to feel really discouraged. I had two touches last week, but haven't heard a thing since. I hope that doesn't mean there's some kind of problem with my petition. I would expect if they intended to send me an RFE they would have done so already. My file date was October 7th, and most of the early October filers have already been approved. Why are they making us wait so long? :(

Yes, I'm on the same boat with you. Have my NOA1 date marked as October 13th and observe now mostly dates from the very end of October popping up in the Igor's list. But unlike you I do not even have touches :( Starting to feel really desperate. But let's be positive and hope for the best. After all, today is just January 20th and according to stats just 50% of Octoberians were approved so far. And since CSC doesn't strictly follow order, petitions were submitted, we can say, we simply are in those second 50%. Which is not as bad as it feels, looking at all those end of October dates in Igor's list, isn't? :)

Yes, I'm on the same boat with you. Have my NOA1 date marked as October 13th and observe now mostly dates from the very end of October popping up in the Igor's list. But unlike you I do not even have touches :( Starting to feel really desperate. But let's be positive and hope for the best. After all, today is just January 20th and according to stats just 50% of Octoberians were approved so far. And since CSC doesn't strictly follow order, petitions were submitted, we can say, we simply are in those second 50%. Which is not as bad as it feels, looking at all those end of October dates in Igor's list, isn't? :)

my situation is the same as urs... my first NOA 1 is on Oct 13th and have touched on Jan. 6,10.. but still haven't heard anything from now.. it is been two week since i have touched... so disappointed.... and starting to worry and worry....

Well, I finally got a response. The dreaded RFE ... Oh well, it's not as if I'm surprised since I pretty much expected it once I discovered this forum and saw that photos often weren't enough evidence to prove a prior meeting. No problem, I've got plenty of evidence to send. I'm just really, really bummed that this case has to be delayed any more. Bastards! Oh well, that's life I suppose. At least I can expect a fairly prompt approval once I get the evidence sent in. Looks like most people got approved within about a week of submitting the required evidence, so I can live with it. Sure is better than waiting!

Ugh, sorry to hear that, BUT it should be an easy fix, no? And did they update your case on the USCIS site, or did you get the RFE in the mail?

I am in the same situation as both of you. I've had two touches on 1/12 and 1/13 and recieved phone calls from NVC last week when they were doing my background check but nothing since then.

How do you know that your RFE is due to lack of evidence? Hopefully, you will get it to them right away and it won't be long until you get your NOA.

Ugh, sorry to hear that, BUT it should be an easy fix, no? And did they update your case on the USCIS site, or did you get the RFE in the mail?

It should be an easy fix. I'm only assuming that the RFE is due to lack of evidence of prior meeting, but not certain. All I sent as evidence initially was several photos, but they weren't labeled, so I'm pretty confident this is the reason. I didn't send any other supporting evidence, and I've read from a number of posts that photos alone aren't enough. I've already prepared passport exit-entry copies, plane ticket copies, transcripts of my study at National Taiwan University and my cell phone contract with Taiwan mobile. As soon as I get the hard copy I'll express mail it.

They did send me both a text message and email, and the USCIS site was also updated (both the date and the actual case status). Here is a copy of the email they sent:

Yes, K and L, I see that. I'm also checking few... well, not few anymore, many times a day :) What scares me is the absence of news. The bad news as well as good means progress. Absence of news, at the other hand, means waiting... possibly long waiting, without any knowledge of the end date. And that is not good at all. That is why I'm so glad not only for the couples who already received their NOA2, but also for those, who got their RFE.

It should be an easy fix. I'm only assuming that the RFE is due to lack of evidence of prior meeting, but not certain. Sounds like you guys are golden. As soon as you get the RFE (assuming that's what it's for ... probably it is), send it in and look forward to approval :P

To everyone who is still waiting: it seems like this is going to be the hardest part. When lots of others are getting approved around you, I'm sure the waiting and uncertainty is 100x worse. Keep the faith, my lovelies (L)

Well, i finally received the hard copy of my RFE yesterday, 01/19/2010. It was actually a different error as what I suspected. It turns out, it's an even "stupider" error on my part :bonk: - apparently, i did not answer part c, question 2 of the I-129F form (if i have ever been convicted by a court of law...) :bonk:

So what I received from the USCIS were:

1) I-797E, Notice of Action (Request for Evidence)

2) Initial Evidence Request - I-129F with the statement:

"OMITTED ITEMS: The petitioner submitted Form I-129F, Petition for Alien Fiance'. However, the form is incomplete. The petitioner must answer question 2 on page 3 (attached). After the petitioner ha answered question 2, re-sign and date the attached form above the original signature and date. Return to USCIS."

3) Page 3 of the I-129F form.

So as a reply, here's what I sent the USCIS:

I-129F - Response to RFE Cover Letter with the following contents included:

1) Copy of the I-797E, Notice of Action (some people actually return the original sheet, but it's written in the back "When you reply, please include a copy of the other side of this notice and also include any papers attached to this notice")

2) Original attachment to I-797E (Page 2 of Initial Evidence Request)

3) Original attachment to I-797E (Page 3 of Initial Evidence Request) with answer to question 2, new signature and date above original signature and date.

4) New copy of page 3 of Form I-129F with answer to question 2, original signature and date signed.

5) 4 copies of my fiancee's revised G-325A with signature and date signed then I briefly explained why i am resubmitting a new G-325A as i missed a couple of items in the original submission.

Argh, I say, argh! That is definitely worth at least two "arghs!" But like TaiwanLover said, it seems they approve shortly after they receive RFE responses, so rush it over there and sit back for your imminent approval :D
