Regarding I-765 Application for EAD

I'm sure this question has been asked hundreds if not thousands of times because I remember coming across it once but I am unable to stumble upon it again.

My husband and I are filing for Adjustment of Status and the last bit of paperwork that we are getting to is our I-765.

When we are filling out the I-765 form, we need to know whether we should be marking the box for 'permission to accept employment', or 'renewal of my permission to accept employment'. My husband had an I-94 stamp in his passport, from when he landed in JFK, which has expired. Are we supposed to mail that in even though it's expired or are we supposed to be requesting permission to accept employment since we have never filled out an I-765 before? Does this even really matter??

I am assuming that it DOES matter, and I'm also guessing that I should be marking the 'renewal' box, but I just want to double check with other people who have already had experience with this part of the process.

We met in October 2007 and our immigration journey started in July 2008 when we filed for the I-129F Fiance Visa petition.
