I got in the US on a K3 visa. My husband & I just filed for AOS last week. He just graduated from AIT & he's being stationed in Baumholder, Germany. I will follow soon after my husband establishes housing there.

Now that I have a pending AOS/I485 (did not file for EAD & AP):

1. Can I travel to Germany even if I have no green card yet plus no Advanced Parole & just comeback for the interview here in the U.S.?

2. Is my husband required to show up on my interview too?

3. How long is the estimated waiting time for the army housing in Baumholder, Germany?

What is the best thing to do here?? :unsure:

I am not sure about all the answers to your questions all I know about is the K-3 visa as I entered the US on it.

On a K-3 visa you can enter the US as often as you like for the 2 years that the visa is valid for. Once the K-3 visa has expired without having your AOS you can no longer leave the US and re-enter without having Advanced Parole.

I have not heard of anyone in a simular possition as you and your husband are in with moving to Germany. I think that if I were you I would make an appointment for an INFOPASS to speak with an immigration officer about your situation.

I am not sure but I would think that leaving the country and not returning would mean that you are abandoning the AOS application. So I think you need to seek advice from the proper people.

Your husband DOES have to appear with you when it comes time for an AOS interview.

Hope you can get some help sorting this one out. Don't forget if you are moving you have to notify the immigration people of a change of address.
