Ok, maybe it's because she's on a K-1 (and I'm not), but I don't understand why such a big deal is made about being out of status. I am out of status right now, and have been for 2.5 years. We will be filing very shortly and because of that, I have been seeking advice around here. Many Canadians in my situation didn't make such a big deal about being out of status. Yes, it's bad and you really shouldn't take it lightly, but I doubt it would be catastrophic. If anything, they will ask why you waited so long and move on. Then again, I'm not here on a K-1, so I might be full of poop right now.

As for the AED, I was under the impression that you get one with the AoS and that since a marriage is involved, you cannot file for AED alone.

Adjustment of Status

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

It's a big deal because if you dont have status in the United States of America and then come to the attention of ICE or USCIS, deportation procedures can be started against you and you can be removed from the country. Filing for AOS protects you from this. Just because you managed to stay in the US without status, doesn't mean that being out of status should EVER be taken lightly. I personally would consider being separated from my husband very catastrophic. Even if it was whilst i was being held by ICE for a few days.

OP: File asap. I understand people may encounter hard financial times, but this really should be a priority and if there is any way you can save the money or borrow it, you should.

Being out of status is NEVER a good idea.

08/21/2009 - AOS package sent

08/28/2009 - NOA 1 for AOS, EAD, AP

08/31/2009 - Cheque cashed

09/05/2009 - Biometrics notice received

09/23/2009 - Biometrics Appointment

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

A couple of years?? Lucky, very lucky!! Wouldn't recommend anyone else being this lax/useless with the AOS or ANY of their paperwork

Nobody recommended we are just sharing experiences. And certainly not judging anyone

gary is right you don't need a lawyer. but also the other members are right if ur detained by cbp ur out of status and probably will be place in removal proceedings. just file ASAP AND YOU WILL ADJUST FINE NO PROBLEM. and don't get cought by cbp or leave the states before you adjust. good luck.

we just filled my AOS , i arrived on a k1 got married in the first 90 days never filled my adjustment (i'm talking about years) , i guess cause i was never on the position where i need to work my hubby provides for everything and so far i haven't had any problems with the paperwork i'll let you know if a do.

My husband and I were married in May and are just managing to save that money up. Would've had it sooner but of course life has to catch up with you at the most inopportune times. We have not run into any issues yet either. We will keep you posted if the USCIS sends our paperwork back because of an expired I-94 :yes:

We met in October 2007 and our immigration journey started in July 2008 when we filed for the I-129F Fiance Visa petition.
