Hi,

sorry if this is not right forum, in that case please point me to right direction.

I got engaged last month in India and my fiancee works there. Her company has already started applying for her L-1 (Intra company transfer) visa. Therefore the question is it ok for her to apply for L-1 visa while engaged to US Citizen or should we drop L-1 and apply for K-1?

The L-1 visa will enable her to travel in a month. I did talk to an attorney and she did say it is allowed to apply for L-1 even if you are engaged to US citizen. Once she comes to US I can do AOS.

My friend went to the US on L-1 visa while she was engaged to a USC.

They got married two years after she arrived at the US, filed AOS and got her GC with no problem.

Are you going to marry her right after she enters the US?

Non-immigrant visa is issued on the basis that the applicant eventually goes back to their country.

It can cause a problem if you marry her right after the entry to the US and file AOS.

It can be seen as abuse or fraud by USCIS.

Did you start the process of filing K1 visa process?, if no, then let her come on the L-1 visa, then after 90 plus days you can get married, then file for AOS.

Thank you very much for responses, I have not started K-1 visa procedure. We will proceed with L-1 visa as we are planning to go back to India for ceremonial wedding.
