~ Happy Sunday ~ :star:

I know im a bother asking and asking the same question but im not getting any answer, hope someone has gone thru the same...

At my husband's interview he was required to get a joint sponsor because I did not have enough income and was unemployed.

So we got someone to do the forms I864A.

I have a question where I might have rushed and put the wrong or / reversed info. (I-864A)

I know this may sound stupid but i confused myself.

BUT here is the question:

For this form I-864A am i the sponsor or the household member ???

Who fills out the 1st part = household member??? (would it be me (his wife) or my friend who is helping us???

Also this person is not related to me so what should they put on relationship to sponsor, if they put other they have to specify, can FRIEND be written there?? I heard from someone that we werent' supposed to be using the I864A but only the I864

(does this form need to be notorized?)

A non household member would complete an I-864. That income is NOT combined with your income.

So that means the I864A is not necessary??

She did filled out the I-864 already and we have her tax transcripts :-)

Ok here is the simple answer to ur question....

You need to fill out I 864 no matter what

Joint sponser needs to fill out I 864

Now....pay attention...if the joint sponser is married, then and then only the spouce of the joint sponser fills out the I 864A....period.

The primary petitioner HAS to fill out the I864, regardless of income.

The joint sponsor will fill an I864 if he lives in a different household than the primary sponsor or an I864A if it's in the same household.

I'm still not clear on what happen is the joint sponsor filing an I864 is married and files taxes jointly BUT makes enough income to support the intending immigrant and his family on his income alone. I've constantly seen conflicting information regarding that.

This is wrong. In the OP's situation, yes the joint sponsor uses the I-864 because they are not in the same household as the petitioner. However, a household member need not be a spouse, so I-864 forms can be used by any household member to combine income when needed. When not needed, there's no need for an I-864a, even if the sponsor or joint sponsor has a spouse.

Pushbrk is correct. I just finished doing this, so here's the simple breakdown:

1.) The petitioner MUST FILL OUT AN I-864 OR an I-864EZ. THIS CANNOT BE AVOIDED.

2.) If the petitioner's income and/or assets are not sufficient to meet poverty guidelines, THEN he/she must find a joint sponsor. A joint sponsor can fill out potentially two forms: an I-864 (if the joint sponsor does not live in the PETITIONER'S household) or an I-864A (if the joint sponsor lives in the same household as the PETITIONER.)

3.) If the joint sponsor fills out the I-864, they follow all of the regular guidelines for the I-864, as documented on this site. This means they have to provide tax transcripts, employment letters, etc., etc. They must also provide proof of residency or citizenship.

4.) If the joint sponsor fills out the I-864A, the same financial information as the I-864 must be submitted, but now instead of proof of residency/citizenship, you have to prove that a.) the joint sponsor inhabits the same household (normally tax transcripts do this for you) and b.) the joint sponsor's RELATIONSHIP to you (unless he/she is claimed as a dependent on your taxes). This is VERY important! If you use a parent or a sibling as a joint sponsor, and they fill out an I-864A, you NEED TO PROVE THEY ARE YOUR PARENT/SIBLING. This means COPIES OF YOUR BIRTH CERTIFICATE(S).

For example, my father filed the I-864A with me, and so I had to submit a copy of MY birth certificate showing that he was listed on it as my father. Because our tax transcripts had the same address for the past 3 years, they accepted that we inhabited the same household. If I had asked my hypothetical brother/sister to fill out an I-864A, then I would need to submit both MY and THEIR birth certificates, to show the same parents. (And again, I should prove that we live in the same household.)
