Hi fellow members.

Newbie question again. I have been reviewing the info on this website forums since the past couple of weeks and am curious as to what percentage of people who apply for IR-1/CR-1 also apply for K3 visa simultaneously?

Seems like most people who contribute to the website are doing both but I wasnt sure and hence the question.

Do you folks recommend filing for K3 also? Please advice because I am soo confused.

My guess is one would get K3 visa about two months before IR-1/CR-1 processing in India if there are no delays in I-129F processing e.g. IMBRA. Just my guess..

Up side of K3 - your spouse would be with you sooner, up side of IR-1/CR-1 - you don't have to worry about AOS, EAD etc.

Some people petition for CR-1, an immigrant visa for a spouse. It's generally a longer route but the spouse enters as a legal permanent resident and is eligible to work.

Others petition for K3, the non-immigrant visa for a spouse. It used to be the shorter route but that's a question mark now that there's an IMBRA backlog. The idea is for the spouse to enter on a non-immigrant visa (similar to a tourist) and complete the immigration process while in the States. The pre-requisite for K3 (form I-129f) is a petition for CR-1 (form I-130).

It's clear that there are delays in I-129f processing. What's not yet clear is how long those delays are going to be - both for the immediate future, because a backlog has built up, and for the long-term.
